9 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 17 | | SECTION 1. Section 74.09(a), Alcoholic Beverage Code, is |
---|
11 | 18 | | amended to read as follows: |
---|
12 | 19 | | (a) In addition to the activities authorized by Section |
---|
13 | 20 | | 74.01, the holder of a brewpub license may sell beer produced under |
---|
14 | 21 | | the license to the holder of a general, local, or branch |
---|
15 | 22 | | distributor's license or to qualified distributors or other |
---|
16 | 23 | | similarly situated entities outside the state. |
---|
17 | 24 | | SECTION 2. Section 74.10(a), Alcoholic Beverage Code, is |
---|
18 | 25 | | amended to read as follows: |
---|
19 | 26 | | (a) In addition to the activities authorized by Section |
---|
20 | 27 | | 74.01, the holder of a brewpub license may sell ale and malt liquor |
---|
21 | 28 | | to the holder of a wholesaler's permit, a general class B |
---|
22 | 29 | | wholesaler's permit, or a local class B wholesaler's permit or to |
---|
23 | 30 | | qualified wholesalers or other similarly situated entities outside |
---|
24 | 31 | | the state. |
---|
25 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
---|
26 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 36 | | Act takes effect September 1, 2017. |
