| 9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 9 | | SECTION 1. Section 228.0545, Transportation Code, is |

| 11 | 10 | | amended by adding Subsection (e) to read as follows: |

| 12 | 11 | | (e) The department may provide that the notice under |
|---|
| 13 | 12 | | Subsection (c), instead of being sent by first class mail, be sent |
|---|
| 14 | 13 | | as an electronic record to a registered owner that agrees to the |
|---|
| 15 | 14 | | terms of the electronic record transmission of the information. |
|---|
| 16 | 15 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 17 | 16 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 18 | 17 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 19 | 18 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 20 | 19 | | Act takes effect September 1, 2017. |
