57 relating to the nature, funding, and functions of the Texas
68 Low-Level Radioactive Waste Compact Commission.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 403.005, Health and Safety Code, is
911 amended to read as follows:
1012 Sec. 403.005. POWERS AND DUTIES. (a) The Texas Low-Level
1113 Radioactive Waste Disposal Compact Commission and the members of
1214 the commission have the powers and duties prescribed by the
1315 compact. The members of the commission are responsible for
1416 administering the provisions of the compact.
1517 (b) The commission may conduct other activities not
1618 described by the federal law governing the commission or the
1719 compact, as long as those activities are consistent with the
1820 policies and procedures of this state.
1921 SECTION 2. Section 403.0051, Health and Safety Code, is
2022 amended to read as follows:
2123 Sec. 403.0051. COMMISSION AS INDEPENDENT ENTITY; FUNDING.
2224 (a) The commission is an independent entity established by federal
2325 law and governed by the compact and is not an agency of this state or
2426 a program, department, or other division of, or administratively
2527 attached to, an agency of this state [the Texas Commission on
2628 Environmental Quality].
2729 (b) The legislature may appropriate money to the
2830 commission. Money for the commission may not be appropriated as
2931 part of an appropriation for the Texas Commission on Environmental
3032 Quality.
3133 (c) The comptroller may:
3234 (1) assign the commission an agency code; and
3335 (2) from funds appropriated to the commission, provide
3436 for the reimbursement of a commission member or employee or a person
3537 who contracts with the commission for purchases approved by the
3638 commission, including state and local sales tax.
3739 SECTION 3. This Act takes effect immediately if it receives
3840 a vote of two-thirds of all the members elected to each house, as
3941 provided by Section 39, Article III, Texas Constitution. If this
4042 Act does not receive the vote necessary for immediate effect, this
4143 Act takes effect September 1, 2017.
