| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 403.005, Health and Safety Code, is |
|---|
| 9 | 11 | | amended to read as follows: |
|---|
| 10 | 12 | | Sec. 403.005. POWERS AND DUTIES. (a) The Texas Low-Level |
|---|
| 11 | 13 | | Radioactive Waste Disposal Compact Commission and the members of |
|---|
| 12 | 14 | | the commission have the powers and duties prescribed by the |
|---|
| 13 | 15 | | compact. The members of the commission are responsible for |
|---|
| 14 | 16 | | administering the provisions of the compact. |
|---|
| 15 | 17 | | (b) The commission may conduct other activities not |
|---|
| 16 | 18 | | described by the federal law governing the commission or the |
|---|
| 17 | 19 | | compact, as long as those activities are consistent with the |
|---|
| 18 | 20 | | policies and procedures of this state. |
|---|
| 19 | 21 | | SECTION 2. Section 403.0051, Health and Safety Code, is |
|---|
| 20 | 22 | | amended to read as follows: |
|---|
| 21 | 23 | | Sec. 403.0051. COMMISSION AS INDEPENDENT ENTITY; FUNDING. |
|---|
| 22 | 24 | | (a) The commission is an independent entity established by federal |
|---|
| 23 | 25 | | law and governed by the compact and is not an agency of this state or |
|---|
| 24 | 26 | | a program, department, or other division of, or administratively |
|---|
| 25 | 27 | | attached to, an agency of this state [the Texas Commission on |
|---|
| 26 | 28 | | Environmental Quality]. |
|---|
| 27 | 29 | | (b) The legislature may appropriate money to the |
|---|
| 28 | 30 | | commission. Money for the commission may not be appropriated as |
|---|
| 29 | 31 | | part of an appropriation for the Texas Commission on Environmental |
|---|
| 30 | 32 | | Quality. |
|---|
| 31 | 33 | | (c) The comptroller may: |
|---|
| 32 | 34 | | (1) assign the commission an agency code; and |
|---|
| 33 | 35 | | (2) from funds appropriated to the commission, provide |
|---|
| 34 | 36 | | for the reimbursement of a commission member or employee or a person |
|---|
| 35 | 37 | | who contracts with the commission for purchases approved by the |
|---|
| 36 | 38 | | commission, including state and local sales tax. |
|---|
| 37 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 43 | | Act takes effect September 1, 2017. |
