66 AN ACT
77 relating to the registration of voters at a polling place during
88 early voting by personal appearance and related procedures.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 12, Election Code, is
1111 amended by adding Section 12.007 to read as follows:
1212 Sec. 12.007. CERTAIN ELECTION OFFICERS ARE VOTER
1313 REGISTRARS. An election officer serving a polling place for early
1414 voting by personal appearance is a deputy voter registrar and has
1515 the same authority as a regular deputy registrar.
1616 SECTION 2. Section 65.054, Election Code, is amended by
1717 adding Subsection (b-1) to read as follows:
1818 (b-1) A provisional ballot cast under Section 85.0312 shall
1919 be accepted if the voter registrar determines the applicant is
2020 eligible for registration under Section 85.0312(d).
2121 SECTION 3. Subchapter B, Chapter 85, Election Code, is
2222 amended by adding Section 85.0312 to read as follows:
2323 Sec. 85.0312. REGISTRATION AT POLLING PLACE DURING EARLY
2424 VOTING. (a) A person who would be eligible to vote in an election
2525 under Section 11.001, but for the requirement to be a registered
2626 voter, shall be accepted during early voting by personal appearance
2727 for voting the ballot for the precinct of the person's residence as
2828 shown by the identification presented if, on the day the person
2929 offers to vote, the person:
3030 (1) submits a voter registration application that
3131 complies with Section 13.002 to an election officer at the polling
3232 place; and
3333 (2) presents as proof of residence:
3434 (A) a Texas driver's license, including a
3535 temporary license or instruction permit, or personal
3636 identification card issued to the person by the Department of
3737 Public Safety that states the person's current address on the day
3838 the person seeks to vote; or
3939 (B) a utility bill addressed to the person dated
4040 not earlier than the 30th day before the date the person seeks to
4141 vote, and:
4242 (i) a driver's license or personal
4343 identification card issued to the person by the Department of
4444 Public Safety that has not expired or that expired no earlier than
4545 60 days before the date of presentation;
4646 (ii) a United States military
4747 identification card that contains the person's photograph that has
4848 not expired or that expired no earlier than 60 days before the date
4949 of presentation;
5050 (iii) a United States citizenship
5151 certificate issued to the person that contains the person's
5252 photograph;
5353 (iv) a United States passport issued to the
5454 person that has not expired or that expired no earlier than 60 days
5555 before the date of presentation;
5656 (v) a license to carry a handgun issued to
5757 the person by the Department of Public Safety that has not expired
5858 or that expired no earlier than 60 days before the date of
5959 presentation; or
6060 (vi) a student identification card issued
6161 by a public or private institution of higher education located in
6262 this state that contains the person's photograph.
6363 (b) The election officer shall make a copy of the proof of
6464 residence submitted under Subsection (a)(2) and attach it to the
6565 registration application. The election officer shall return the
6666 original proof of residence to the voter.
6767 (c) A person voting under this section shall vote a
6868 provisional ballot in the manner provided by Section 63.011 except
6969 that the person is not required to submit the affidavit under
7070 Section 63.011(a).
7171 (d) For each registration corresponding to a ballot cast
7272 under this section, the voter registrar shall review the
7373 application and copy of the proof of residence and determine
7474 whether the applicant is eligible for registration as provided by
7575 Subchapter C, Chapter 13. The registrar shall inform the early
7676 voting ballot board of a determination made under this subsection.
7777 A registration approved under this subsection takes effect on the
7878 date the vote was cast.
7979 (e) The secretary of state may by rule:
8080 (1) designate additional documents that a person may
8181 offer to prove the person's residence to register and vote under
8282 this section; and
8383 (2) prescribe procedures to implement this section.
8484 SECTION 4. This Act takes effect September 1, 2017.
