125 A BILL TO BE ENTITLED
136 AN ACT
147 relating to the establishment of the Communicable Disease and
158 Public Health Center.
169 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1710 SECTION 1. The purpose of this Act is to:
1811 (1) address the communicable disease and public health
1912 challenges of the international border region;
2013 (2) develop a unified message that will enable this
2114 state to:
2215 (A) maximize the use of local resources;
2316 (B) increase efficiency and reduce duplication
2417 of staff resources; and
2518 (C) strengthen collaboration with local
2619 governmental entities; and
2720 (3) foster a greater local and regional capacity to
2821 address the diseases and allow the border region and this state to
2922 capitalize on the expertise and insight of local health
3023 professionals and departments to better serve the border
3124 communities and region and this state.
3225 SECTION 2. Chapter 81, Health and Safety Code, is amended by
3326 adding Subchapter K to read as follows:
3427 SUBCHAPTER K. COMMUNICABLE DISEASE AND PUBLIC HEALTH CENTER
3528 Sec. 81.451. DEFINITION. In this subchapter, "center"
3629 means the Communicable Disease and Public Health Center established
3730 under this subchapter.
3831 Sec. 81.452. MEMORANDUM OF UNDERSTANDING TO ESTABLISH
39- CENTER. The department may enter into a memorandum of
32+ CENTER. The department shall enter into a memorandum of
4033 understanding with a county located on an international border that
4134 has a population of at least 700,000 and that has as its county seat
4235 a municipality with a population of less than 100,000 to establish
4336 and jointly operate a Communicable Disease and Public Health
4437 Center.
4538 Sec. 81.453. DONATION OF LAND. The governing body of a
46- county described by Section 81.452, or a municipality, institution
47- of higher education, community organization, or health care
48- provider in that county, may donate real property to the department
49- for the center. The donation may be in fee simple or otherwise.
50- Sec. 81.454. ASSISTANCE FROM CERTAIN ENTITIES. The local
39+ county described by Section 81.452, or a municipality in that
40+ county, may donate real property to the department for the center.
41+ The donation may be in fee simple or otherwise.
42+ Sec. 81.454. ASSISTANCE FROM MUNICIPALITY. The local
5143 health department of a county that enters into a memorandum of
5244 understanding under Section 81.452 may seek the assistance of a
53- municipality, institution of higher education, community
54- organization, or health care provider in the local health
55- department's jurisdiction to establish and operate the center.

5647 Sec. 81.455. COMMUNICABLE DISEASE AND PUBLIC HEALTH CENTER.
57- (a) The governing body of a county described by Section 81.452 may
58- enter into an agreement with a municipality, institution of higher
59- education, community organization, or health care provider in that
60- county to:

6149 (1) provide a central repository of vector control
6250 resources for municipalities in a county described by Section
6351 81.452 and counties adjacent to that county;
6452 (2) develop local surveillance, outreach, and
6553 response campaigns to address communicable disease and potential
6654 vectors of communicable disease;
6755 (3) provide local, regional, and international
6856 health-related briefings;
6957 (4) cooperate with local, regional, state, and
7058 international officials to:
7159 (A) increase environmental awareness to reduce
7260 sources for vector development; and
7361 (B) develop recommendations for implementing
7462 nuisance abatement policies;
7563 (5) with the assistance of appropriate authorities,
76- facilitate any necessary method of vector control, including
77- trapping, adulticiding, and larviciding of vector populations
78- along the international border;
64+ facilitate trapping, adulticiding, and larviciding of vector
65+ populations along the international border;
7966 (6) provide to health care professionals current
8067 information, including health advisories and guidance with
8168 communicable disease case management, regarding communicable
8269 disease and potential vectors of communicable disease;
83- (7) in cooperation with state, federal, and
84- international partners, educate and provide health care screenings
85- to populations at high risk of contracting a communicable disease
86- that are traditionally difficult to contact, including individuals
87- not lawfully present in the United States; and
88- (8) facilitate information sharing between local and
89- state entities.
70+ (7) in cooperation with federal and international
71+ partners, educate and provide health care screenings to populations
72+ at high risk of contracting a communicable disease that are
73+ traditionally difficult to contact, including individuals not
74+ lawfully present in the United States; and
75+ (8) facilitate information sharing between local

9077 (b) A local campaign developed under Subsection (a)(2) must
9178 be in both English and Spanish.
9279 (c) The center may serve as a call center for concerns
9380 regarding communicable disease and public health along the
9481 international border.
95- (d) A local health department in each county immediately
96- adjacent to an international border shall report to the center
97- information regarding:

9885 (1) incidents of communicable disease in the county;
9986 (2) public health challenges in the county; and
10087 (3) any other public health or communicable disease
10188 issue, as required by the department.
10289 (e) The local health department of a county that enters into
10390 a memorandum of understanding under Section 81.452 shall:
10491 (1) collaborate with the local health department of
10592 each adjoining county; and
10693 (2) meet with a representative of each local health
107- department described by Subdivision (1) to discuss the health
108- status of each county and address the occurrence and control of
109- communicable disease in each county.

11097 SECTION 3. This Act takes effect September 1, 2017.
