8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 15 | | SECTION 1. Section 248A.152, Health and Safety Code, is |
---|
10 | 16 | | amended by amending Subsection (c) and adding Subsection (d) to |
---|
11 | 17 | | read as follows: |

12 | 18 | | (c) A center's building must be suitable for use as a |
---|
13 | 19 | | prescribed pediatric extended care center and must provide a |
---|
14 | 20 | | minimum of 60 square feet of space for each child, exclusive of a |
---|
15 | 21 | | space that is: |
---|
16 | 22 | | (1) a kitchen; |
---|
17 | 23 | | (2) a bathroom; |
---|
18 | 24 | | (3) a storage area; |
---|
19 | 25 | | (4) a stairway; and |
---|
20 | 26 | | (5) an unfinished basement or attic. |
---|
21 | 27 | | (d) The maximum patient capacity at a center may not exceed |
---|
22 | 28 | | 100 [60]. |
---|
23 | 29 | | SECTION 2. Section 248A.152(c), Health and Safety Code, as |
---|
24 | 30 | | amended by this Act, does not apply to a prescribed pediatric |
---|
25 | 31 | | extended care center that has a maximum patient capacity of 60 or |
---|
26 | 32 | | fewer patients and that was operating immediately before the |
---|
27 | 33 | | effective date of this Act. |

28 | 34 | | SECTION 3. This Act takes effect September 1, 2017. |
