410 A BILL TO BE ENTITLED
511 AN ACT
612 relating to a building used as a prescribed pediatric extended care
713 center.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 248A.152, Health and Safety Code, is
1016 amended by amending Subsection (c) and adding Subsection (d) to
1117 read as follows:
1218 (c) A center's building must be suitable for use as a
1319 prescribed pediatric extended care center and must provide a
1420 minimum of 60 square feet of space for each child, exclusive of a
1521 space that is:
1622 (1) a kitchen;
1723 (2) a bathroom;
1824 (3) a storage area;
1925 (4) a stairway; and
2026 (5) an unfinished basement or attic.
2127 (d) The maximum patient capacity at a center may not exceed
2228 100 [60].
2329 SECTION 2. Section 248A.152(c), Health and Safety Code, as
2430 amended by this Act, does not apply to a prescribed pediatric
2531 extended care center that has a maximum patient capacity of 60 or
2632 fewer patients and that was operating immediately before the
2733 effective date of this Act.
2834 SECTION 3. This Act takes effect September 1, 2017.
