| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle A, Title 3, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 116 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 116. SUICIDE PREVENTION TRAINING FOR CERTAIN MENTAL HEALTH |
|---|
| 13 | 13 | | PROFESSIONALS |
|---|
| 14 | 14 | | Sec. 116.001. DEFINITIONS. In this chapter, "mental health |
|---|
| 15 | 15 | | professional" and "mental health services" have the meanings |
|---|
| 16 | 16 | | assigned by Section 164.003, Health and Safety Code. |
|---|
| 17 | 17 | | Sec. 116.002. SUICIDE PREVENTION TRAINING. (a) A mental |
|---|
| 18 | 18 | | health professional must complete four hours of suicide prevention |
|---|
| 19 | 19 | | training before the mental health professional may provide mental |
|---|
| 20 | 20 | | health services: |
|---|
| 21 | 21 | | (1) in the scope of employment with this state; |
|---|
| 22 | 22 | | (2) under a contract with this state; |
|---|
| 23 | 23 | | (3) in the scope of employment with an organization |
|---|
| 24 | 24 | | that receives funding from this state; or |
|---|
| 25 | 25 | | (4) under a contract with an organization that |
|---|
| 26 | 26 | | receives funding from this state. |
|---|
| 27 | 27 | | (b) The Department of State Health Services, the Texas |
|---|
| 28 | 28 | | Medical Board, the Texas Board of Nursing, the Texas State Board of |
|---|
| 29 | 29 | | Examiners of Psychologists, the Texas State Board of Examiners of |
|---|
| 30 | 30 | | Marriage and Family Therapists, the Texas State Board of Examiners |
|---|
| 31 | 31 | | of Professional Counselors, and the Texas State Board of Social |
|---|
| 32 | 32 | | Worker Examiners shall jointly approve suicide prevention training |
|---|
| 33 | 33 | | courses that may be completed by mental health professionals to |
|---|
| 34 | 34 | | satisfy the suicide prevention training requirement of Subsection |
|---|
| 35 | 35 | | (a). |
|---|
| 36 | 36 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 37 | 37 | | of this Act, the Department of State Health Services shall develop a |
|---|
| 38 | 38 | | process for notifying mental health professionals who are employed |
|---|
| 39 | 39 | | by or provide mental health services under a contract with this |
|---|
| 40 | 40 | | state or an organization that receives funding from this state of |
|---|
| 41 | 41 | | the suicide prevention training requirement of Section 116.002(a), |
|---|
| 42 | 42 | | Occupations Code, as added by this Act. |
|---|
| 43 | 43 | | SECTION 3. Section 116.002(a), Occupations Code, as added |
|---|
| 44 | 44 | | by this Act, applies only to mental health services provided as |
|---|
| 45 | 45 | | described by that section on or after September 1, 2019. |
|---|
| 46 | 46 | | SECTION 4. This Act takes effect September 1, 2017. |
