66 AN ACT
77 relating to suicide prevention training for certain mental health
88 professionals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 3, Occupations Code, is
1111 amended by adding Chapter 116 to read as follows:
1212 CHAPTER 116. SUICIDE PREVENTION TRAINING FOR CERTAIN MENTAL HEALTH
1313 PROFESSIONALS
1414 Sec. 116.001. DEFINITIONS. In this chapter, "mental health
1515 professional" and "mental health services" have the meanings
1616 assigned by Section 164.003, Health and Safety Code.
1717 Sec. 116.002. SUICIDE PREVENTION TRAINING. (a) A mental
1818 health professional must complete four hours of suicide prevention
1919 training before the mental health professional may provide mental
2020 health services:
2121 (1) in the scope of employment with this state;
2222 (2) under a contract with this state;
2323 (3) in the scope of employment with an organization
2424 that receives funding from this state; or
2525 (4) under a contract with an organization that
2626 receives funding from this state.
2727 (b) The Department of State Health Services, the Texas
2828 Medical Board, the Texas Board of Nursing, the Texas State Board of
2929 Examiners of Psychologists, the Texas State Board of Examiners of
3030 Marriage and Family Therapists, the Texas State Board of Examiners
3131 of Professional Counselors, and the Texas State Board of Social
3232 Worker Examiners shall jointly approve suicide prevention training
3333 courses that may be completed by mental health professionals to
3434 satisfy the suicide prevention training requirement of Subsection
3535 (a).
3636 SECTION 2. As soon as practicable after the effective date
3737 of this Act, the Department of State Health Services shall develop a
3838 process for notifying mental health professionals who are employed
3939 by or provide mental health services under a contract with this
4040 state or an organization that receives funding from this state of
4141 the suicide prevention training requirement of Section 116.002(a),
4242 Occupations Code, as added by this Act.
4343 SECTION 3. Section 116.002(a), Occupations Code, as added
4444 by this Act, applies only to mental health services provided as
4545 described by that section on or after September 1, 2019.
4646 SECTION 4. This Act takes effect September 1, 2017.
