66 AN ACT
77 relating to the Internet broadcast of open meetings of the Texas
88 Alcoholic Beverage Commission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 5, Alcoholic Beverage
1111 Code, is amended by adding Section 5.071 to read as follows:
1212 Sec. 5.071. INTERNET BROADCAST AND ARCHIVE OF OPEN
1313 MEETINGS. (a) The commission shall:
1414 (1) broadcast over the Internet live video and audio
1515 of each meeting of the commission that is an open meeting subject to
1616 Chapter 551, Government Code;
1717 (2) make a video and audio recording of reasonable
1818 quality of the broadcast; and
1919 (3) provide access to the archived video and audio of
2020 the meeting on the commission's Internet website.
2121 (b) Not later than the seventh day after the date an open
2222 meeting of the commission is broadcast under this section, the
2323 commission shall make available through the commission's Internet
2424 website archived video and audio of the meeting. The commission
2525 shall maintain the archived video and audio of the meeting on the
2626 commission's Internet website for not less than two years after the
2727 date the archived video and audio was first made available on the
2828 website.
2929 (c) The commission shall provide on the commission's
3030 Internet website the same notice of an open meeting of the
3131 commission that the commission is required to post under Subchapter
3232 C, Chapter 551, Government Code. The notice must be posted on the
3333 commission's Internet website within the time required for posting
3434 notice under that subchapter.
3535 (d) The commission may use for an Internet broadcast of an
3636 open meeting of the commission under this section a room made
3737 available to the commission on request in any state building, as
3838 that term is defined by Section 2165.301, Government Code.
3939 (e) The commission is exempt from the requirements of this
4040 section to the extent a catastrophe, as defined by Section
4141 551.0411, Government Code, or a technical breakdown prevents the
4242 commission from complying with this section. Following the
4343 catastrophe or technical breakdown, the commission shall make all
4444 reasonable efforts to make the required video and audio of the open
4545 meeting available in a timely manner.
4646 (f) The commission shall consider contracting through
4747 competitive bidding with a private individual or entity to
4848 broadcast and archive an open meeting subject to this section to
4949 minimize the cost of complying with this section.
5050 SECTION 2. Section 5.071, Alcoholic Beverage Code, as added
5151 by this Act, applies only to an open meeting held on or after
5252 September 1, 2019.
5353 SECTION 3. This Act takes effect September 1, 2017.
