| 7 | 7 | | relating to the use of corrugated stainless steel tubing in |

| 8 | 8 | | residential and commercial structures. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 766.001, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Subdivisions (1-a) and (4-a) to read as follows: |
|---|
| 12 | 12 | | (1-a) "Corrugated stainless steel tubing" means a type |
|---|
| 13 | 13 | | of conduit that is meant for the transport of natural gas with |
|---|
| 14 | 14 | | residential structure application and consists of corrugated |
|---|
| 15 | 15 | | stainless steel or another similar corrugated conduit identified by |
|---|
| 16 | 16 | | state fire marshal order. |
|---|
| 17 | 17 | | (4-a) "Residential dwelling" means a structure that |
|---|
| 18 | 18 | | has one or more residential units that are occupied as, or designed |
|---|
| 19 | 19 | | or intended for occupancy as, a residence by individuals. |
|---|
| 20 | 20 | | SECTION 2. Subchapter A, Chapter 766, Health and Safety |
|---|
| 21 | 21 | | Code, is amended by adding Section 766.004 to read as follows: |
|---|
| 22 | 22 | | Sec. 766.004. REQUIREMENTS ON USE OF CORRUGATED STAINLESS |
|---|
| 23 | 23 | | STEEL TUBING. Corrugated stainless steel tubing in each |
|---|
| 24 | 24 | | residential dwelling constructed in this state must conform to the |
|---|
| 25 | 25 | | standards of the 2008 International Residential Code or to a |
|---|
| 26 | 26 | | version of that code that is adopted by ordinance of the largest |
|---|
| 27 | 27 | | municipality in the county in which the dwelling is located and that |
|---|
| 28 | 28 | | is at least as stringent as the 2008 version of that code. |
|---|
| 29 | 29 | | SECTION 3. Subtitle A, Title 9, Health and Safety Code, is |
|---|
| 30 | 30 | | amended by adding Chapter 766A to read as follows: |
|---|
| 31 | 31 | | CHAPTER 766A. FIRE SAFETY IN COMMERCIAL STRUCTURES |
|---|
| 32 | 32 | | Sec. 766A.001. DEFINITIONS. In this chapter: |
|---|
| 33 | 33 | | (1) "Commercial structure" means a structure that is |
|---|
| 34 | 34 | | occupied for, or designed or intended for occupancy for, a |
|---|
| 35 | 35 | | commercial purpose. |
|---|
| 36 | 36 | | (2) "Corrugated stainless steel tubing" means a type |
|---|
| 37 | 37 | | of conduit that is meant for the transport of natural gas with |
|---|
| 38 | 38 | | commercial structure application and consists of corrugated |
|---|
| 39 | 39 | | stainless steel or another similar corrugated conduit identified by |
|---|
| 40 | 40 | | state fire marshal order. |

| 41 | 41 | | Sec. 766A.002. REQUIREMENTS ON USE OF CORRUGATED STAINLESS |
|---|
| 42 | 42 | | STEEL TUBING. Corrugated stainless steel tubing in each commercial |
|---|
| 43 | 43 | | structure constructed in this state must conform to the minimum |
|---|
| 44 | 44 | | standards adopted by state fire marshal order. |
|---|
| 45 | 45 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 46 | 46 | | to corrugated stainless steel tubing installed in a structure on or |
|---|
| 47 | 47 | | after the effective date of this Act. Corrugated stainless steel |
|---|
| 48 | 48 | | tubing installed before the effective date of this Act is governed |
|---|
| 49 | 49 | | by the law in effect on the date the tubing was installed, and that |
|---|
| 50 | 50 | | law is continued in effect for that purpose. |
|---|
| 51 | 51 | | SECTION 5. This Act takes effect September 1, 2017. |
