66 AN ACT
77 relating to the use of corrugated stainless steel tubing in
88 residential and commercial structures.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 766.001, Health and Safety Code, is
1111 amended by adding Subdivisions (1-a) and (4-a) to read as follows:
1212 (1-a) "Corrugated stainless steel tubing" means a type
1313 of conduit that is meant for the transport of natural gas with
1414 residential structure application and consists of corrugated
1515 stainless steel or another similar corrugated conduit identified by
1616 state fire marshal order.
1717 (4-a) "Residential dwelling" means a structure that
1818 has one or more residential units that are occupied as, or designed
1919 or intended for occupancy as, a residence by individuals.
2020 SECTION 2. Subchapter A, Chapter 766, Health and Safety
2121 Code, is amended by adding Section 766.004 to read as follows:
2222 Sec. 766.004. REQUIREMENTS ON USE OF CORRUGATED STAINLESS
2323 STEEL TUBING. Corrugated stainless steel tubing in each
2424 residential dwelling constructed in this state must conform to the
2525 standards of the 2008 International Residential Code or to a
2626 version of that code that is adopted by ordinance of the largest
2727 municipality in the county in which the dwelling is located and that
2828 is at least as stringent as the 2008 version of that code.
2929 SECTION 3. Subtitle A, Title 9, Health and Safety Code, is
3030 amended by adding Chapter 766A to read as follows:
3131 CHAPTER 766A. FIRE SAFETY IN COMMERCIAL STRUCTURES
3232 Sec. 766A.001. DEFINITIONS. In this chapter:
3333 (1) "Commercial structure" means a structure that is
3434 occupied for, or designed or intended for occupancy for, a
3535 commercial purpose.
3636 (2) "Corrugated stainless steel tubing" means a type
3737 of conduit that is meant for the transport of natural gas with
3838 commercial structure application and consists of corrugated
3939 stainless steel or another similar corrugated conduit identified by
4040 state fire marshal order.
4141 Sec. 766A.002. REQUIREMENTS ON USE OF CORRUGATED STAINLESS
4242 STEEL TUBING. Corrugated stainless steel tubing in each commercial
4343 structure constructed in this state must conform to the minimum
4444 standards adopted by state fire marshal order.
4545 SECTION 4. The change in law made by this Act applies only
4646 to corrugated stainless steel tubing installed in a structure on or
4747 after the effective date of this Act. Corrugated stainless steel
4848 tubing installed before the effective date of this Act is governed
4949 by the law in effect on the date the tubing was installed, and that
5050 law is continued in effect for that purpose.
5151 SECTION 5. This Act takes effect September 1, 2017.
