| 11 | 11 | SECTION 1. Subchapter C, Chapter 361, Health and Safety | |
| 12 | 12 | Code, is amended by adding Section 361.1215 to read as follows: | |
| 13 | 13 | Sec. 361.1215. SOIL MONITORING SAMPLE COLLECTION FOR LAND | |
| 14 | 14 | APPLICATION OF SEWAGE SLUDGE OR DOMESTIC SEPTAGE. (a) In this | |
| 15 | 15 | section: | |
| 16 | 16 | (1) "Domestic septage" means liquid or solid material | |
| 17 | 17 | removed from a septic tank, cesspool, portable toilet, marine | |
| 18 | 18 | sanitation device, or similar treatment works that receives only | |
| 19 | 19 | domestic sewage. The term does not include: | |
| 20 | 20 | (A) liquid or solid material removed from a | |
| 21 | 21 | septic tank, cesspool, or similar treatment works that receives | |
| 22 | 22 | commercial wastewater or industrial wastewater; or | |
| 23 | 23 | (B) grease removed from a grease trap. | |
| 24 | 24 | (2) "Land application unit" has the meaning assigned | |
| 25 | 25 | by Section 361.121(a). | |
| 26 | 26 | (b) Soil monitoring samples required by the commission for a | |
| 27 | 27 | land application unit at which sewage sludge or domestic septage is | |
| 28 | 28 | applied must be collected by a commission inspector. | |
| 29 | 29 | SECTION 2. This Act takes effect September 1, 2017. |
