77 relating to the uniform election date.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 41.001(a) and (b), Election Code, are
1010 amended to read as follows:
1111 (a) Except as otherwise provided by this subchapter, each
1212 general or special election in this state shall be held on [one of
1313 the following dates:
1414 [(1) the first Saturday in May in an odd-numbered
1515 year;
1616 [(2) the first Saturday in May in an even-numbered
1717 year, for an election held by a political subdivision other than a
1818 county; or
1919 [(3)] the first Tuesday after the first Monday in
2020 November.
2121 (b) Subsection (a) does not apply to:
2222 (1) a runoff election;
2323 (2) an election to resolve a tie vote;
2424 (3) an election held under an order of a court or other
2525 tribunal;
2626 (4) an emergency election ordered under Section
2727 41.0011;
2828 (5) an expedited election to fill a vacancy in the
2929 legislature held under Section 203.013;
3030 [(6) an election held under a statute that expressly
3131 provides that the requirement of Subsection (a) does not apply to
3232 the election;] or
3333 (6) [(7)] the initial election of the members of the
3434 governing body of a newly incorporated city.
3535 SECTION 2. Section 41.0052(a), Election Code, is amended to
3636 read as follows:
3737 (a) The governing body of a political subdivision, other
3838 than a county [or municipal utility district], that holds its
3939 general election for officers on a date other than the November
4040 uniform election date shall [may], not later than January 1, 2018
4141 [December 31, 2016], change the date on which it holds its general
4242 election for officers to the November uniform election date.
4343 SECTION 3. Sections 41.001(c) and (d) and Section
4444 41.0052(e), Election Code, are repealed.
4545 SECTION 4. This Act takes effect September 1, 2017.
