| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 41.001(a) and (b), Election Code, are |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (a) Except as otherwise provided by this subchapter, each |
|---|
| 12 | 12 | | general or special election in this state shall be held on [one of |
|---|
| 13 | 13 | | the following dates: |
|---|
| 14 | 14 | | [(1) the first Saturday in May in an odd-numbered |
|---|
| 15 | 15 | | year; |
|---|
| 16 | 16 | | [(2) the first Saturday in May in an even-numbered |
|---|
| 17 | 17 | | year, for an election held by a political subdivision other than a |
|---|
| 18 | 18 | | county; or |
|---|
| 19 | 19 | | [(3)] the first Tuesday after the first Monday in |
|---|
| 20 | 20 | | November. |
|---|
| 21 | 21 | | (b) Subsection (a) does not apply to: |
|---|
| 22 | 22 | | (1) a runoff election; |
|---|
| 23 | 23 | | (2) an election to resolve a tie vote; |
|---|
| 24 | 24 | | (3) an election held under an order of a court or other |
|---|
| 25 | 25 | | tribunal; |
|---|
| 26 | 26 | | (4) an emergency election ordered under Section |
|---|
| 27 | 27 | | 41.0011; |
|---|
| 28 | 28 | | (5) an expedited election to fill a vacancy in the |
|---|
| 29 | 29 | | legislature held under Section 203.013; |
|---|
| 30 | 30 | | [(6) an election held under a statute that expressly |
|---|
| 31 | 31 | | provides that the requirement of Subsection (a) does not apply to |
|---|
| 32 | 32 | | the election;] or |
|---|
| 33 | 33 | | (6) [(7)] the initial election of the members of the |
|---|
| 34 | 34 | | governing body of a newly incorporated city. |
|---|
| 35 | 35 | | SECTION 2. Section 41.0052(a), Election Code, is amended to |
|---|
| 36 | 36 | | read as follows: |
|---|
| 37 | 37 | | (a) The governing body of a political subdivision, other |
|---|
| 38 | 38 | | than a county [or municipal utility district], that holds its |
|---|
| 39 | 39 | | general election for officers on a date other than the November |
|---|
| 40 | 40 | | uniform election date shall [may], not later than January 1, 2018 |
|---|
| 41 | 41 | | [December 31, 2016], change the date on which it holds its general |
|---|
| 42 | 42 | | election for officers to the November uniform election date. |
|---|
| 43 | 43 | | SECTION 3. Sections 41.001(c) and (d) and Section |
|---|
| 44 | 44 | | 41.0052(e), Election Code, are repealed. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2017. |
