510 AN ACT
611 relating to recognition of certain identification documents by
712 governmental officials.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Subtitle A, Title 6, Government Code, is amended
1015 by adding Chapter 620 to read as follows:
1116 CHAPTER 620. RECOGNITION OF CERTAIN IDENTIFICATION DOCUMENTS
1217 Sec. 620.001. DEFINITIONS. In this chapter:
1318 (1) "Governmental entity" means:
1419 (A) the state;
1520 (B) a political subdivision of the state,
1621 including a municipality, a county, or any kind of district; or
1722 (C) an institution, board, commission, office,
1823 department, court, or other agency:
1924 (i) in the executive, judicial, or
2025 legislative branch of state government, including an institution of
2126 higher education as defined by Section 61.003, Education Code; or
2227 (ii) of a political subdivision of the
2328 state.
2429 (2) "Governmental official" means an employee, agent,
2530 or elected or appointed official of a governmental entity. The term
2631 does not include an election officer accepting a voter under
2732 Chapter 63, Election Code.
2833 Sec. 620.002. RECOGNITION OF CERTAIN IDENTIFICATION
2934 DOCUMENTS BY GOVERNMENTAL OFFICIALS. (a) A governmental official
3035 may not accept, rely on, or otherwise use an identification
3136 document for the purpose of determining a person's identity or
3237 residency unless the document is expressly authorized for that
3338 purpose under Subsection (b).
3439 (b) The secretary of state by rule shall specify the
3540 identification documents that may be accepted by a governmental
3641 official. Rules adopted under this subsection:
3742 (1) may not authorize an identification document
3843 issued by a political subdivision of this state; and
3944 (2) must require that foreign identification
4045 documents include appropriate security measures to ensure
4146 authenticity.
4247 Sec. 620.003. CERTAIN IDENTIFICATION DOCUMENT POLICIES
4348 PROHIBITED. (a) A governmental entity may not adopt or enforce a
4449 rule, ordinance, order, policy, or other measure that is
4550 inconsistent with Section 620.002.
4651 (b) A rule, ordinance, order, policy, or other measure that
4752 is inconsistent with Section 620.002 is void.
4853 Sec. 620.004. EFFECT ON ELECTION LAW. This chapter may not
4954 be construed to have any effect on state election law, including the
5055 acceptable forms of photo identification under Chapter 63, Election
5156 Code.
5257 SECTION 2. This Act takes effect September 1, 2017.
