| 7 | 7 | | relating to full-time online programs provided through the state |

| 8 | 8 | | virtual school network. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 26.0031(c-1), Education Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (c-1) A school district or open-enrollment charter school |
|---|
| 13 | 13 | | may decline to pay the cost for a student of more than three |
|---|
| 14 | 14 | | yearlong electronic courses, or the equivalent, during any school |
|---|
| 15 | 15 | | year. This subsection does not: |
|---|
| 16 | 16 | | (1) limit the ability of the student to enroll in |
|---|
| 17 | 17 | | additional electronic courses at the student's cost; or |
|---|
| 18 | 18 | | (2) apply to a student enrolled in a full-time online |
|---|
| 19 | 19 | | program that: |
|---|
| 20 | 20 | | (A) was operating on January 1, 2013; or |
|---|
| 21 | 21 | | (B) is operated by a school district for the |
|---|
| 22 | 22 | | benefit of students eligible to attend a school in the school |
|---|
| 23 | 23 | | district under Section 25.001 or by an open-enrollment charter |
|---|
| 24 | 24 | | school for the benefit of students eligible for admission to the |
|---|
| 25 | 25 | | campus or program under Subchapter D, Chapter 12. |

| 26 | 26 | | SECTION 2. Section 30A.153(a-1), Education Code, is amended |
|---|
| 27 | 27 | | to read as follows: |
|---|
| 28 | 28 | | (a-1) For purposes of Subsection (a), a school district or |
|---|
| 29 | 29 | | open-enrollment charter school is limited to the funding described |
|---|
| 30 | 30 | | by that subsection for a student's enrollment in not more than three |
|---|
| 31 | 31 | | electronic courses during any school year, unless the student is |
|---|
| 32 | 32 | | enrolled in a full-time online program that: |
|---|
| 33 | 33 | | (1) was operating on January 1, 2013; or |
|---|
| 34 | 34 | | (2) is operated by a school district for the benefit of |
|---|
| 35 | 35 | | students eligible to attend a school in the school district under |
|---|
| 36 | 36 | | Section 25.001 or by an open-enrollment charter school for the |
|---|
| 37 | 37 | | benefit of students eligible for admission to the campus or program |
|---|
| 38 | 38 | | under Subchapter D, Chapter 12. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2017. |
