66 AN ACT
77 relating to full-time online programs provided through the state
88 virtual school network.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 26.0031(c-1), Education Code, is amended
1111 to read as follows:
1212 (c-1) A school district or open-enrollment charter school
1313 may decline to pay the cost for a student of more than three
1414 yearlong electronic courses, or the equivalent, during any school
1515 year. This subsection does not:
1616 (1) limit the ability of the student to enroll in
1717 additional electronic courses at the student's cost; or
1818 (2) apply to a student enrolled in a full-time online
1919 program that:
2020 (A) was operating on January 1, 2013; or
2121 (B) is operated by a school district for the
2222 benefit of students eligible to attend a school in the school
2323 district under Section 25.001 or by an open-enrollment charter
2424 school for the benefit of students eligible for admission to the
2525 campus or program under Subchapter D, Chapter 12.
2626 SECTION 2. Section 30A.153(a-1), Education Code, is amended
2727 to read as follows:
2828 (a-1) For purposes of Subsection (a), a school district or
2929 open-enrollment charter school is limited to the funding described
3030 by that subsection for a student's enrollment in not more than three
3131 electronic courses during any school year, unless the student is
3232 enrolled in a full-time online program that:
3333 (1) was operating on January 1, 2013; or
3434 (2) is operated by a school district for the benefit of
3535 students eligible to attend a school in the school district under
3636 Section 25.001 or by an open-enrollment charter school for the
3737 benefit of students eligible for admission to the campus or program
3838 under Subchapter D, Chapter 12.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2017.
