66 AN ACT
77 relating to historically underutilized businesses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2161.065(a), Government Code, is amended
1010 to read as follows:
1111 (a) The commission shall design a mentor-protege program to
1212 foster long-term relationships between prime contractors and
1313 historically underutilized businesses and to increase the ability
1414 of historically underutilized businesses to contract with the state
1515 or to receive subcontracts under a state contract. Each state
1616 agency with a biennial appropriation that exceeds $5 [$10] million
1717 shall implement the program designed by the commission.
1818 SECTION 2. Sections 2161.123(d) and (f), Government Code,
1919 are amended to read as follows:
2020 (d) The comptroller [commission] and the state auditor
2121 shall cooperate to develop procedures providing for random periodic
2222 monitoring of state agency compliance with this section. The state
2323 auditor shall report to the comptroller [commission] a state agency
2424 that is not complying with this section. In determining whether a
2525 state agency is making a good faith effort to comply, the state
2626 auditor shall consider whether the agency:
2727 (1) has adopted rules under Section 2161.003;
2828 (2) has used the comptroller's [commission's]
2929 directory under Section 2161.064 and other resources to identify
3030 historically underutilized businesses that are able and available
3131 to contract with the agency;
3232 (3) made good faith, timely efforts to contact
3333 identified historically underutilized businesses regarding
3434 contracting opportunities;
3535 (4) conducted its procurement program in accordance
3636 with the good faith effort methodology set out in comptroller
3737 [commission] rules; and
3838 (5) established goals for contracting with
3939 historically underutilized businesses in each procurement category
4040 based on:
4141 (A) scheduled fiscal year expenditures; [and]
4242 (B) the availability of historically
4343 underutilized businesses in each category as determined by rules
4444 adopted under Section 2161.002; and
4545 (C) an accurate representation of the number of
4646 historically underutilized businesses in each category.
4747 (f) If the state auditor reports to the comptroller
4848 [commission] that a state agency is not complying with this
4949 section, the comptroller [commission] shall assist the agency in
5050 complying with this section and shall prepare for inclusion with
5151 the agency's strategic plan a written plan for increasing the
5252 agency's use of historically underutilized businesses.
5353 SECTION 3. Section 2161.251(a), Government Code, is amended
5454 to read as follows:
5555 (a) This subchapter applies to all contracts entered into by
5656 a state agency with an expected value of $50,000 [$100,000] or more,
5757 including:
5858 (1) contracts for the acquisition of a good or
5959 service; and
6060 (2) contracts for or related to the construction of a
6161 public building, road, or other public work.
6262 SECTION 4. Section 2161.252(a), Government Code, is amended
6363 to read as follows:
6464 (a) Each state agency that considers entering into a
6565 contract with an expected value of $50,000 [$100,000] or more
6666 shall, before the agency solicits bids, proposals, offers, or other
6767 applicable expressions of interest for the contract, determine
6868 whether there will be subcontracting opportunities under the
6969 contract. If the state agency determines that there is that
7070 probability, the agency shall require that each bid, proposal,
7171 offer, or other applicable expression of interest for the contract
7272 include a historically underutilized business subcontracting plan.
7373 SECTION 5. The changes in law made by this Act apply only to
7474 a contract for goods or services that is entered into on or after
7575 the effective date of this Act. A contract entered into before the
7676 effective date of this Act is governed by the law in effect on the
7777 date the contract was entered into, and the former law is continued
7878 in effect for that purpose.
7979 SECTION 6. This Act takes effect September 1, 2017.
