68 Developmental Disabilities to The University of Texas at Austin and
79 renaming the office the Office for Healthy Children.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 531.0202(b), Government Code, is amended
1012 to read as follows:
1113 (b) The Department of Aging and Disability Services is
1214 [following state agency and entity are] abolished on a date that is
1315 within the period prescribed by Section 531.02001(2), that is
1416 specified in the transition plan required under Section 531.0204
1517 for the abolition of the department [state agency or entity], and
1618 that occurs after all of the department's [state agency's or
1719 entity's] functions have been transferred to the commission in
1820 accordance with Sections 531.0201 and 531.02011[:
1921 [(1) the Department of Aging and Disability Services;
2022 and
2123 [(2) the Office for the Prevention of Developmental
2224 Disabilities].
2325 SECTION 2. Chapter 67, Education Code, is amended by adding
2426 Subchapter E, and a heading is added to that subchapter to read as
2527 follows:
2628 SUBCHAPTER E. OFFICE FOR HEALTHY CHILDREN
2729 SECTION 3. Sections 112.041, 112.042, 112.043, 112.044,
2830 112.047, 112.0471, 112.0472, 112.048, 112.049, 112.050, and
2931 112.051, Human Resources Code, are transferred to Subchapter E,
3032 Chapter 67, Education Code, as added by this Act, redesignated as
3133 Sections 67.81, 67.82, 67.83, 67.84, 67.85, 67.86, 67.87, 67.88,
3234 67.89, 67.90, and 67.91, Education Code, respectively, and amended
3335 to read as follows:
3436 Sec. 67.81 [112.041]. PURPOSE AND POLICY. (a) The purpose
3537 of this subchapter [Act] is to minimize the economic and human
3638 losses in Texas caused by preventable disabilities through the
3739 establishment of a joint private-public initiative called the
3840 Office for Healthy Children [the Prevention of Developmental
3941 Disabilities].
4042 (b) The legislature finds there is a strong need for a
4143 unified, comprehensive prevention effort in the State of Texas.
4244 Many state agencies, as well as private organizations and local
4345 public agencies, are involved in prevention activities that can
4446 reduce the incidence and severity of developmental disabilities.
4547 However, a coordinated statewide plan that identifies and
4648 consolidates research findings and prevention activities has yet to
4749 be developed.
4850 (c) The legislature further finds that by establishing a
4951 mechanism by which prevention activities can be better coordinated
5052 and needed prevention programs can be initiated, the State of Texas
5153 will be making an important investment in Texas's future.
5254 Sec. 67.82 [112.042]. DEFINITIONS. In this subchapter:
5355 (1) ["Commission" means the Health and Human Services
5456 Commission.
5557 [(1-a)] "Developmental disability" means a severe,
5658 chronic disability that:
5759 (A) is attributable to a mental or physical
5860 impairment or to a combination of a mental and physical impairment;
5961 (B) is manifested in a person before the [a]
6062 person reaches the age of 22;
6163 (C) is likely to continue indefinitely;
6264 (D) results in substantial functional
6365 limitations in three or more major life activities, including:
6466 (i) self-care;
6567 (ii) receptive and expressive language;
6668 (iii) learning;
6769 (iv) mobility;
6870 (v) self-direction;
6971 (vi) capacity for independent living; and
7072 (vii) economic sufficiency; and
7173 (E) reflects the person's needs for a combination
7274 and sequence of special interdisciplinary or generic care,
7375 treatment, or other lifelong or extended services that are
7476 individually planned and coordinated.
7577 (2) [(1-b) "Executive commissioner" means the
7678 executive commissioner of the Health and Human Services Commission.
7779 [(2) "Executive committee" means the executive
7880 committee of the Office for the Prevention of Developmental
7981 Disabilities.
8082 [(3)] "Office" means the Office for Healthy Children
8183 [the Prevention of Developmental Disabilities].
8284 Sec. 67.83 [112.043]. OFFICE FOR HEALTHY CHILDREN [THE
8385 PREVENTION OF DEVELOPMENTAL DISABILITIES; ADMINISTRATIVE
8486 ATTACHMENT]. [(a)] The Office for Healthy Children [the
8587 Prevention of Developmental Disabilities] is established under and
8688 administered by [administratively attached to] the university
8789 [Health and Human Services Commission].
8890 [(b) The Health and Human Services Commission shall:
8991 [(1) provide administrative assistance, services, and
9092 materials to the office;
9193 [(2) accept, deposit, and disburse money made
9294 available to the office;
9395 [(3) accept gifts and grants on behalf of the office
9496 from any public or private entity;
9597 [(4) pay the salaries and benefits of the executive
9698 director and staff of the office;
9799 [(5) reimburse the travel expenses and other actual
98100 and necessary expenses of the executive committee, executive
99101 director, and staff of the office incurred in the performance of a
100102 function of the office, as provided by the General Appropriations
101103 Act;
102104 [(6) apply for and receive on behalf of the office any
103105 appropriations, gifts, or other money from the state or federal
104106 government or any other public or private entity, subject to
105107 limitations and conditions prescribed by legislative
106108 appropriation;
107109 [(7) provide the office with adequate computer
108110 equipment and support; and
109111 [(8) provide the office with adequate office space and
110112 permit the executive committee to meet in facilities of the
111113 commission.
112114 [(c) The executive director and staff of the office are
113115 employees of the office and not employees of the Health and Human
114116 Services Commission.]
115117 Sec. 67.84 [112.044]. DUTIES. The office shall:
116118 (1) educate the public and attempt to promote sound
117119 public policy regarding the prevention of developmental
118120 disabilities;
119121 (2) identify, collect, and disseminate information
120122 and data concerning the causes, frequency of occurrence, and
121123 preventability of developmental disabilities;
122124 (3) work with appropriate [divisions within the
123125 commission,] state agencies[,] and other entities to develop a
124126 coordinated long-range plan to effectively monitor and reduce the
125127 incidence or severity of developmental disabilities;
126128 (4) promote and facilitate the identification,
127129 development, coordination, and delivery of needed prevention
128130 services;
129131 (5) solicit, receive, and spend grants and donations
130132 from public, private, state, and federal sources;
131133 (6) identify and encourage establishment of needed
132134 reporting systems to track the causes and frequencies of occurrence
133135 of developmental disabilities;
134136 (7) develop, operate, and monitor programs created
135137 under Section 67.88 [112.048] addressing the prevention of specific
136138 targeted developmental disabilities;
137139 (8) [monitor and assess the effectiveness of divisions
138140 within the commission and of state agencies in preventing
139141 developmental disabilities;
140142 [(9)] recommend the role each [division within the
141143 commission and each] state agency should have with regard to
142144 prevention of developmental disabilities;
143145 (9) [(10)] facilitate coordination of state agency
144146 prevention services and activities [within the commission and]
145147 among appropriate state agencies; and
146148 (10) [(11)] encourage cooperative, comprehensive, and
147149 complementary planning among public, private, and volunteer
148150 individuals and organizations engaged in prevention activities,
149151 providing prevention services, or conducting related research.
150152 Sec. 67.85 [112.047]. [EXECUTIVE] DIRECTOR. (a) The
151153 president of the university or the president's designee [executive
152154 committee] may hire a [an executive] director to [serve as the chief
153155 executive officer of the office and to] perform the administrative
154156 duties of the office.
155157 (b) The [executive] director serves at the will of the
156158 president of the university or the president's designee [executive
157159 committee].
158160 (c) The [executive] director may hire staff within
159161 guidelines established by the president of the university or the
160162 president's designee [executive committee].
161163 Sec. 67.86 [112.0471]. QUALIFICATIONS AND STANDARDS OF
162164 CONDUCT. The [executive] director or the [executive] director's
163165 designee shall provide to the president of the university or the
164166 president's designee [members of the executive committee] and to
165167 employees of the office, as often as necessary, information
166168 regarding the requirements for office or employment under this
167169 subchapter, including information regarding a person's
168170 responsibilities under applicable laws relating to standards of
169171 conduct for state officers or employees.
170172 Sec. 67.87 [112.0472]. EQUAL EMPLOYMENT OPPORTUNITY
171173 POLICIES. (a) The [executive] director shall prepare and maintain
172174 a written policy statement that implements a program of equal
173175 employment opportunity to ensure that all personnel decisions are
174176 made without regard to race, color, disability, sex, religion, age,
175177 or national origin.
176178 (b) The policy statement must include:
177179 (1) personnel policies, including policies relating
178180 to recruitment, evaluation, selection, training, and promotion of
179181 personnel, that show the intent of the office to avoid the unlawful
180182 employment practices described by Chapter 21, Labor Code; and
181183 (2) an analysis of the extent to which the composition
182184 of the office's personnel is in accordance with state and federal
183185 law and a description of reasonable methods to achieve compliance
184186 with state and federal law.
185187 (c) The policy statement must:
186188 (1) be updated annually;
187189 (2) be reviewed by the Texas Workforce Commission
188190 civil rights division for compliance with Subsection (b)(1); and
189191 (3) be filed with the governor's office.
190192 Sec. 67.88 [112.048]. PREVENTION PROGRAMS FOR TARGETED
191193 DEVELOPMENTAL DISABILITIES. (a) The office [executive committee]
192194 shall establish guidelines for:
193195 (1) selecting targeted disabilities;
194196 (2) assessing prevention services needs; and
195197 (3) reviewing plans, budgets, and operations for
196198 programs under this section.
197199 (b) The office [executive committee] shall plan and
198200 implement prevention programs for specifically targeted
199201 developmental disabilities.
200202 (c) A program under this section:
201203 (1) must include a plan designed to reduce the
202204 incidence of a specifically targeted disability;
203205 (2) must include a budget for implementing a plan;
204206 (3) must be funded through:
205207 (A) contracts for services from participating
206208 agencies;
207209 (B) grants and gifts from private persons and
208210 consumer and advocacy organizations; and
209211 (C) foundation support; and
210212 (4) must be approved by the president of the
211213 university or the president's designee [executive committee].
212214 Sec. 67.89 [112.049]. EVALUATION. (a) The office shall
213215 identify or encourage the establishment of needed statistical bases
214216 for each targeted group against which the office can measure how
215217 effectively a program under Section 67.88 [112.048] is reducing the
216218 frequency or severity of a targeted developmental disability.
217219 (b) The president of the university or the president's
218220 designee [executive committee] shall regularly monitor and
219221 evaluate the results of programs under Section 67.88 [112.048].
220222 Sec. 67.90 [112.050]. GRANTS AND OTHER FUNDING. (a) The
221223 president of the university or the president's designee [executive
222224 committee] may apply for and distribute private, state, and federal
223225 funds to implement prevention policies set by the president of the
224226 university or the president's designee [executive committee].
225227 (b) The president of the university or the president's
226228 designee [executive committee] shall establish criteria for
227229 application and review of funding requests and accountability
228230 standards for recipients. The president of the university or the
229231 president's designee [executive committee] may adjust its criteria
230232 as necessary to meet requirements for federal funding.
231233 (c) The board [executive committee] may not submit a
232234 legislative appropriation request for general revenue funds for
233235 purposes of this subchapter.
234236 (d) In addition to funding under Subsection (a), the office
235237 may accept and solicit gifts, donations, and grants of money from
236238 public and private sources, including the federal government, local
237239 governments, and private entities, to assist in financing the
238240 duties and functions of the office. The university [commission]
239241 shall support office fund-raising efforts authorized by this
240242 subsection. Funds raised under this subsection are administered by
241243 the university and may only be spent in furtherance of a duty or
242244 function of the office or in accordance with rules applicable to the
243245 office. The university shall maintain a separate accounting of
244246 funds raised under this subsection.
245247 Sec. 67.91 [112.051]. REPORTS TO LEGISLATURE. The office
246248 shall submit by February 1 of each odd-numbered year biennial
247249 reports to the legislature detailing findings of the office and the
248250 results of programs under Section 67.88 [112.048] and recommending
249251 improvements in the delivery of developmental disability
250252 prevention services.
251253 SECTION 4. Section 22.04(c)(3), Penal Code, is amended to
252254 read as follows:
253255 (3) "Disabled individual" means a person:
254256 (A) with one or more of the following:
255257 (i) autism spectrum disorder, as defined by
256258 Section 1355.001, Insurance Code;
257259 (ii) developmental disability, as defined
258260 by Section 67.82 [112.042], Education [Human Resources] Code;
259261 (iii) intellectual disability, as defined
260262 by Section 591.003, Health and Safety Code;
261263 (iv) severe emotional disturbance, as
262264 defined by Section 261.001, Family Code; or
263265 (v) traumatic brain injury, as defined by
264266 Section 92.001, Health and Safety Code; or
265267 (B) who otherwise by reason of age or physical or
266268 mental disease, defect, or injury is substantially unable to
267269 protect the person's self from harm or to provide food, shelter, or
268270 medical care for the person's self.
269271 SECTION 5. The following provisions of the Human Resources
270272 Code are repealed:
271273 (1) Sections 112.0421, 112.0431, 112.045, 112.0451,
272274 112.0452, 112.0453, 112.0454, and 112.046; and
273275 (2) the heading to Subchapter C, Chapter 112.
274276 SECTION 6. (a) On the effective date of this Act:
275277 (1) the Office for the Prevention of Developmental
276278 Disabilities is abolished as an independent office, transferred to
277279 The University of Texas at Austin as a program, and renamed the
278280 Office for Healthy Children;
279281 (2) the executive committee and the board of advisors
280282 of the Office for the Prevention of Developmental Disabilities are
281283 abolished;
282284 (3) the position of executive director of the Office
283285 for the Prevention of Developmental Disabilities is abolished, but
284286 the president of The University of Texas at Austin or the
285287 president's designee may hire the person serving as the executive
286288 director immediately before the effective date of this Act for a
287289 position in the office;
288290 (4) an employee of the Office for the Prevention of
289291 Developmental Disabilities becomes an employee of The University of
290292 Texas at Austin;
291293 (5) all money, including gifts, donations, and grants
292294 of money, contracts, leases, rights, and obligations of the Office
293295 for the Prevention of Developmental Disabilities are transferred to
294296 The University of Texas at Austin;
295297 (6) all property, including records, in the custody of
296298 the Office for the Prevention of Developmental Disabilities becomes
297299 the property of The University of Texas at Austin;
298300 (7) all funds appropriated by the legislature to the
299301 Office for the Prevention of Developmental Disabilities are
300302 transferred to The University of Texas at Austin; and
301303 (8) all functions and activities performed by the
302304 Office for the Prevention of Developmental Disabilities are
303305 transferred to The University of Texas at Austin.
304306 (b) The validity of an action taken by the Office for the
305307 Prevention of Developmental Disabilities or the executive
306308 committee or board of advisors of the office before the effective
307309 date of this Act is not affected by the abolishment of the office.
308310 (c) A rule, form, policy, procedure, or decision of the
309311 Office for the Prevention of Developmental Disabilities or the
310312 Health and Human Services Commission that is related to the office
311313 is continued in effect as a rule, form, policy, procedure, or
312314 decision of The University of Texas System until superseded by a
313315 rule, form, policy, procedure, or decision of the system.
314316 (d) Any action or proceeding pending before the Office for
315317 the Prevention of Developmental Disabilities on the effective date
316318 of this Act becomes an action or proceeding before The University of
317319 Texas at Austin.
318320 SECTION 7. This Act takes effect August 31, 2017.
