66 AN ACT
77 relating to the school district grievance procedures for resolving
88 complaints received by students' parents or guardians.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 26.011, Education Code, is amended to
1111 read as follows:
1212 Sec. 26.011. COMPLAINTS. (a) The board of trustees of each
1313 school district shall adopt a grievance procedure under which the
1414 board shall address each complaint that the board receives from a
1515 parent or guardian of a student or that otherwise concerns a
1616 [concerning] violation of a right guaranteed by this chapter or
1717 other law.
1818 (b) The grievance procedure adopted under Subsection (a)
1919 must encourage the use of an alternative dispute resolution
2020 procedure described by Chapter 154, Civil Practice and Remedies
2121 Code, for the resolution of a complaint the board receives from a
2222 parent or guardian of a student.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2017.
