44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the regulation of the parking and removal of vehicles on
77 the campus of a public institution of higher education.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 51.202, Education Code, is amended by
1010 adding Subsection (c) to read as follows:
1111 (c) The booting, towing, and storage of a vehicle on
1212 institutional property is governed by the rules and regulations
1313 adopted under this section. To the extent of any conflict, those
1414 rules and regulations prevail over Chapter 2308, Occupations Code,
1515 and the following requirements of that chapter do not apply:
1616 (1) as to a tow truck owned or operated by the
1717 institution, the requirements of Subchapter C;
1818 (2) as to a person employed by the institution, the
1919 requirements of Subchapter D;
2020 (3) the signage and notice requirements of Subchapter
2121 F or G;
2222 (4) the requirement of Section 2308.205 and 2308.252
2323 that a towing company tow a vehicle to a licensed vehicle storage
2424 facility; and
2525 (5) the insurance requirement of Section 2308.255.
2626 SECTION 2. Section 2308.004, Occupations Code, is amended
2727 by adding Subsection (c) to read as follows:
2828 (c) This chapter applies to the booting, towing, and storage
2929 of a vehicle on the property of an institution of higher education,
3030 as defined by Section 61.003, Education Code, only as provided by
3131 Section 51.202, Education Code.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 the vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2017.
