| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 522.023(h), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (h) An applicant who pays the applicable fee required by |
|---|
| 13 | 13 | | Section 522.029 or for whom a waiver is authorized under Section |
|---|
| 14 | 14 | | 522.029(a-1) is entitled to three examinations of each element |
|---|
| 15 | 15 | | under Section 522.022. If the applicant has not qualified after the |
|---|
| 16 | 16 | | third examination, the applicant must submit a new application |
|---|
| 17 | 17 | | accompanied by the required fee. |
|---|
| 18 | 18 | | SECTION 2. Section 522.029, Transportation Code, is amended |
|---|
| 19 | 19 | | by adding Subsection (a-1) to read as follows: |
|---|
| 20 | 20 | | (a-1) The department shall waive the fee required by |
|---|
| 21 | 21 | | Subsection (a) and any applicable administrative fee if the |
|---|
| 22 | 22 | | application is for an original issuance of a commercial driver's |
|---|
| 23 | 23 | | license and the applicant is a veteran of the United States armed |
|---|
| 24 | 24 | | forces who, within 365 days preceding the date of the application, |
|---|
| 25 | 25 | | was honorably discharged from the branch of service in which the |
|---|
| 26 | 26 | | person served. |
|---|
| 27 | 27 | | SECTION 3. Section 522.029(a-1), Transportation Code, as |
|---|
| 28 | 28 | | added by this Act, applies only to a commercial driver's license for |
|---|
| 29 | 29 | | which an application was submitted on or after the effective date of |
|---|
| 30 | 30 | | this Act. A commercial driver's license for which an application |
|---|
| 31 | 31 | | was submitted before the effective date of this Act is governed by |
|---|
| 32 | 32 | | the law in effect when the application was submitted, and the former |
|---|
| 33 | 33 | | law is continued in effect for that purpose. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect September 1, 2017. |
