55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to waiving fees for an original commercial driver's
88 license for veterans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 522.023(h), Transportation Code, is
1111 amended to read as follows:
1212 (h) An applicant who pays the applicable fee required by
1313 Section 522.029 or for whom a waiver is authorized under Section
1414 522.029(a-1) is entitled to three examinations of each element
1515 under Section 522.022. If the applicant has not qualified after the
1616 third examination, the applicant must submit a new application
1717 accompanied by the required fee.
1818 SECTION 2. Section 522.029, Transportation Code, is amended
1919 by adding Subsection (a-1) to read as follows:
2020 (a-1) The department shall waive the fee required by
2121 Subsection (a) and any applicable administrative fee if the
2222 application is for an original issuance of a commercial driver's
2323 license and the applicant is a veteran of the United States armed
2424 forces who, within 365 days preceding the date of the application,
2525 was honorably discharged from the branch of service in which the
2626 person served.
2727 SECTION 3. Section 522.029(a-1), Transportation Code, as
2828 added by this Act, applies only to a commercial driver's license for
2929 which an application was submitted on or after the effective date of
3030 this Act. A commercial driver's license for which an application
3131 was submitted before the effective date of this Act is governed by
3232 the law in effect when the application was submitted, and the former
3333 law is continued in effect for that purpose.
3434 SECTION 4. This Act takes effect September 1, 2017.
