55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of information regarding firearm safety
88 and suicide prevention.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.188(b), Government Code, is amended
1111 to read as follows:
1212 (b) Only qualified handgun instructors may administer the
1313 classroom instruction part or the range instruction part of the
1414 handgun proficiency course. The classroom instruction part of the
1515 course must include not less than four hours and not more than six
1616 hours of instruction on:
1717 (1) the laws that relate to weapons and to the use of
1818 deadly force;
1919 (2) handgun use and safety, including use of restraint
2020 holsters and methods to ensure the secure carrying of openly
2121 carried handguns;
2222 (3) nonviolent dispute resolution; [and]
2323 (4) proper storage practices for handguns with an
2424 emphasis on storage practices that eliminate the possibility of
2525 accidental injury to a child; and
2626 (5) the information described by Section 411.189(a).
2727 SECTION 2. Section 411.190(b), Government Code, is amended
2828 to read as follows:
2929 (b) In addition to the qualifications described by
3030 Subsection (a), a qualified handgun instructor must be qualified to
3131 instruct persons in:
3232 (1) the laws that relate to weapons and to the use of
3333 deadly force;
3434 (2) handgun use, proficiency, and safety, including
3535 use of restraint holsters and methods to ensure the secure carrying
3636 of openly carried handguns;
3737 (3) nonviolent dispute resolution; [and]
3838 (4) proper storage practices for handguns, including
3939 storage practices that eliminate the possibility of accidental
4040 injury to a child; and
4141 (5) the information described by Section 411.189(a).
4242 SECTION 3. Subchapter H, Chapter 411, Government Code, is
4343 amended by adding Section 411.189 to read as follows:
4444 Sec. 411.189. FIREARM SAFETY AND SUICIDE PREVENTION
4545 INFORMATION. (a) The department shall post the following on the
4646 department's Internet website:
4747 (1) information regarding:
4848 (A) the importance of an owner of a firearm
4949 safely storing the firearm, particularly when a member of the
5050 owner's family or household is at risk of suicide;
5151 (B) the warning signs that a person is at risk of
5252 suicide; and
5353 (C) the rate of suicide in this state, including
5454 statistics regarding the method of suicide used; and
5555 (2) the phone number for the National Suicide
5656 Prevention Lifeline.
5757 (b) The department shall also include on the department's
5858 Internet website information regarding the risk of suicide among
5959 various age groups and veterans and the importance of safely
6060 storing firearms around a person who is at risk of suicide.
6161 (c) The department may provide the information described by
6262 Subsection (a) to:
6363 (1) a person who is a licensed firearms dealer under 18
6464 U.S.C. Section 923;
6565 (2) an owner or operator of a sport shooting range, as
6666 defined by Section 250.001, Local Government Code; or
6767 (3) a promoter or operator of a gun show.
6868 (d) The department may partner with suicide prevention
6969 programs and use existing resources to provide the information
7070 described by Subsection (a).
7171 SECTION 4. Subchapter B, Chapter 531, Government Code, is
7272 amended by adding Section 531.02493 to read as follows:
7373 Sec. 531.02493. FIREARM SAFETY AND SUICIDE PREVENTION
7474 INFORMATION. (a) On the commission's Internet website the
7575 commission shall post evidence-based information regarding the
7676 importance of an owner of a firearm safely storing the firearm,
7777 particularly when a member of the owner's family or household is at
7878 risk of suicide.
7979 (b) The commission shall also include the information
8080 described by Subsection (a) on any portion of the commission's
8181 Internet website that provides information primarily to veterans or
8282 to minors and their parents.
8383 (c) The commission may provide the information described by
8484 Subsection (a) to:
8585 (1) a person who is a licensed firearms dealer under 18
8686 U.S.C. Section 923;
8787 (2) an owner or operator of a sport shooting range, as
8888 defined by Section 250.001, Local Government Code; or
8989 (3) a promoter or operator of a gun show.
9090 (d) The commission may partner with suicide prevention
9191 programs and use existing resources to provide the information
9292 described by Subsection (a).
9393 SECTION 5. This Act takes effect September 1, 2017.
