| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 152.032(d), Local Government Code, is |
|---|
| 9 | 11 | | amended to read as follows: |
|---|
| 10 | 12 | | (d) The amount of the compensation and allowances of a |
|---|
| 11 | 13 | | county auditor in a county subject to this subsection may be set in |
|---|
| 12 | 14 | | an amount that exceeds the limit established by Subsection (a) if |
|---|
| 13 | 15 | | the compensation and allowances are approved by the commissioners |
|---|
| 14 | 16 | | court of the county. This subsection applies only to: |
|---|
| 15 | 17 | | (1) a county with a population of more than 108,000 and |
|---|
| 16 | 18 | | less than 110,000; |
|---|
| 17 | 19 | | (2) a county with a population of 120,000 or more, |
|---|
| 18 | 20 | | excluding a county subject to Subsection (b); |
|---|
| 19 | 21 | | (3) a county with a population of more than 1,000 and |
|---|
| 20 | 22 | | less than 23,000 that borders the Gulf of Mexico; [and] |
|---|
| 21 | 23 | | (4) a county with a population of more than 11,000 and |
|---|
| 22 | 24 | | less than 11,650; and |
|---|
| 23 | 25 | | (5) a county that: |
|---|
| 24 | 26 | | (A) borders a county with a population of more |
|---|
| 25 | 27 | | than one million; and |
|---|
| 26 | 28 | | (B) has a population of more than 36,000 and less |
|---|
| 27 | 29 | | than 40,000. |
|---|
| 28 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 34 | | Act takes effect September 1, 2017. |
