55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to conditions of community supervision for defendants
88 convicted of certain criminal offenses involving animals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 42A.511, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 42A.511. COMMUNITY SUPERVISION FOR CERTAIN OFFENSES
1313 INVOLVING ANIMALS. If a judge grants community supervision to a
1414 defendant convicted of an offense under Section 42.09, 42.091,
1515 42.092, or 42.10, Penal Code, the judge may require the defendant
1616 to:
1717 (1) complete an online responsible pet owner course
1818 approved by the Texas Department of Licensing and Regulation; or
1919 (2) attend a responsible pet owner course sponsored by
2020 a municipal animal shelter, as defined by Section 823.001, Health
2121 and Safety Code, that:
2222 (A) [(1)] receives federal, state, county, or
2323 municipal funds; and
2424 (B) [(2)] serves the county in which the court is
2525 located.
2626 SECTION 2. Not later than the 120th day after the effective
2727 date of this Act, the Texas Department of Licensing and Regulation
2828 shall approve at least one online responsible pet owner course for
2929 the purposes of Article 42A.511, Code of Criminal Procedure, as
3030 amended by this Act.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2017.
