| 7 | 7 | | relating to conditions of community supervision for defendants |

| 8 | 8 | | convicted of certain criminal offenses involving animals. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article 42A.511, Code of Criminal Procedure, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Art. 42A.511. COMMUNITY SUPERVISION FOR CERTAIN OFFENSES |
|---|
| 13 | 13 | | INVOLVING ANIMALS. If a judge grants community supervision to a |
|---|
| 14 | 14 | | defendant convicted of an offense under Section 42.09, 42.091, |
|---|
| 15 | 15 | | 42.092, or 42.10, Penal Code, the judge may require the defendant |
|---|
| 16 | 16 | | to: |
|---|
| 17 | 17 | | (1) complete an online responsible pet owner course |
|---|
| 18 | 18 | | approved by the Texas Department of Licensing and Regulation; or |
|---|
| 19 | 19 | | (2) attend a responsible pet owner course sponsored by |
|---|
| 20 | 20 | | a municipal animal shelter, as defined by Section 823.001, Health |
|---|
| 21 | 21 | | and Safety Code, that: |
|---|
| 22 | 22 | | (A) [(1)] receives federal, state, county, or |
|---|
| 23 | 23 | | municipal funds; and |
|---|
| 24 | 24 | | (B) [(2)] serves the county in which the court is |
|---|
| 25 | 25 | | located. |
|---|
| 26 | 26 | | SECTION 2. Not later than the 120th day after the effective |
|---|
| 27 | 27 | | date of this Act, the Texas Department of Licensing and Regulation |
|---|
| 28 | 28 | | shall approve at least one online responsible pet owner course for |
|---|
| 29 | 29 | | the purposes of Article 42A.511, Code of Criminal Procedure, as |
|---|
| 30 | 30 | | amended by this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2017. |
