46 AN ACT
57 relating to the student loan default prevention and financial aid
68 literacy pilot program.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Sections 61.0763(a), (b), (c), and (d),
911 Education Code, are amended to read as follows:
1012 (a) [In this section, "career school or college" has the
1113 meaning assigned by Section 132.001.
1214 [(b)] Not later than January 1, 2014, [the board shall
1315 establish and administer] a pilot program shall be established at
1416 selected postsecondary educational institutions to ensure that
1517 students of those institutions are informed consumers with regard
1618 to all aspects of student financial aid, including:
1719 (1) the consequences of borrowing to finance a
1820 student's postsecondary education;
1921 (2) the financial consequences of a student's academic
2022 and career choices; and
2123 (3) strategies for avoiding student loan delinquency
2224 and default.
2325 (b) At [(c) The board shall select at] least one
2426 institution from each of the following categories of postsecondary
2527 educational institutions must be selected to participate in the
2628 program:
2729 (1) general academic teaching institutions;
2830 (2) public junior colleges; and
2931 (3) private or independent institutions of higher
3032 education[; and
3133 [(4) career schools or colleges].
3234 (c) [(d)] In selecting postsecondary educational
3335 institutions to participate in the pilot program, [the board shall
3436 give] priority shall be given to institutions that are recognized
3537 by the United States Department of Education as minority-serving
3638 institutions, including minority institutions under Section 1067k
3739 of the Higher Education Act of 1965 (20 U.S.C. Section 1001 et seq.)
3840 [have a three-year cohort student loan default rate, as reported by
3941 the United States Department of Education:
4042 [(1) of more than 20 percent; or
4143 [(2) that has above average growth as compared to the
4244 rates of other postsecondary educational institutions in this
4345 state].
4446 SECTION 2. Section 57.011, Education Code, is amended by
4547 adding Subsection (f) to read as follows:
4648 (f) In accordance with an agreement with the Texas Higher
4749 Education Coordinating Board, the Texas Guaranteed Student Loan
4850 Corporation shall administer the pilot program established under
4951 Section 61.0763. The corporation shall submit to the governor, the
5052 lieutenant governor, and the speaker of the house of
5153 representatives any annual report or end of program report the
5254 corporation submits to the United States Department of Education in
5355 administering the pilot program. This subsection expires December
5456 31, 2019.
5557 SECTION 3. Sections 61.0763(e), (f), and (g), Education
5658 Code, are repealed.
5759 SECTION 4. This Act takes effect immediately if it receives
5860 a vote of two-thirds of all the members elected to each house, as
5961 provided by Section 39, Article III, Texas Constitution. If this
6062 Act does not receive the vote necessary for immediate effect, this
6163 Act takes effect September 1, 2017.
