105 A BILL TO BE ENTITLED
116 AN ACT
127 relating to reporting and disseminating information regarding
138 public school disciplinary actions.
149 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1510 SECTION 1. The heading to Section 37.020, Education Code,
1611 is amended to read as follows:
1712 Sec. 37.020. REPORTS RELATING TO SUSPENSIONS, EXPULSIONS,
1813 AND DISCIPLINARY ALTERNATIVE EDUCATION PROGRAM PLACEMENTS.
1914 SECTION 2. Section 37.020, Education Code, is amended by
2015 adding Subsections (d) and (e) to read as follows:
2116 (d) For each suspension under Section 37.005, the district
2217 shall report:
2318 (1) information identifying the student, including
24- the student's race, sex, and date of birth and whether the student
25- is in a special education program under Subchapter A, Chapter 29, or
26- covered by Section 504, Rehabilitation Act of 1973 (29 U.S.C.
27- Section 794), that will enable the agency to compare placement data
28- with information collected through other reports;
19+ the student's race, sex, and date of birth, that will enable the
20+ agency to compare placement data with information collected through
21+ other reports;
2922 (2) information indicating the basis for the
3023 suspension;
3124 (3) the number of full or partial days the student was
3225 suspended; and
3326 (4) the number of suspensions that were inconsistent
3427 with the guidelines included in the student code of conduct under
3528 Section 37.001(a)(3).
3629 (e) The agency shall make information collected under this
37- section, disaggregated by race, sex, and age of the student and
38- whether the student is in a special education program under
39- Subchapter A, Chapter 29, or covered by Section 504, Rehabilitation
40- Act of 1973 (29 U.S.C. Section 794), available to the public in a
41- manner that does not identify an individual student. The agency
42- shall also make the information available to the public in a manner
43- showing all intersectional data for the categories described by
44- this subsection.

4533 SECTION 3. This Act applies beginning with the 2017-2018
4634 school year.
4735 SECTION 4. This Act takes effect immediately if it receives
4836 a vote of two-thirds of all the members elected to each house, as
4937 provided by Section 39, Article III, Texas Constitution. If this
5038 Act does not receive the vote necessary for immediate effect, this
5139 Act takes effect September 1, 2017.
