| 8 | 8 | | groundwater conservation district to another. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 36, Water Code, is amended by adding |
|---|
| 11 | 11 | | Subchapter J-1 to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER J-1. TRANSFER OF CERTAIN TERRITORY |
|---|
| 13 | 13 | | Sec. 36.341. PETITION TO TRANSFER. The owner of a parcel of |
|---|
| 14 | 14 | | land that is greater than 1,000 acres in area and is included in the |
|---|
| 15 | 15 | | territory of two or more groundwater conservation districts by a |
|---|
| 16 | 16 | | petition presented to the districts may request that the districts |
|---|
| 17 | 17 | | transfer portions of their territories as necessary for the entire |
|---|
| 18 | 18 | | parcel to be included in the territory of a single district. |
|---|
| 19 | 19 | | Sec. 36.342. CONTENTS OF PETITION. A petition submitted |
|---|
| 20 | 20 | | under this subchapter must: |
|---|
| 21 | 21 | | (1) accurately describe the boundaries of the parcel; |
|---|
| 22 | 22 | | and |
|---|
| 23 | 23 | | (2) provide a statement from a district that is |
|---|
| 24 | 24 | | proposed to receive the portion of the parcel that the district is |
|---|
| 25 | 25 | | willing to accept the land into its territory. |
|---|
| 26 | 26 | | Sec. 36.343. ACTIONS ON RECEIVING PETITION. (a) Each |
|---|
| 27 | 27 | | district on receiving a petition under this subchapter shall |
|---|
| 28 | 28 | | undertake to enter into an agreement with the other district or |
|---|
| 29 | 29 | | districts to effectuate the transfer of territory as requested and |
|---|
| 30 | 30 | | within a reasonable period of time. If a district from which |
|---|
| 31 | 31 | | territory is to be removed under this section has outstanding debt |
|---|
| 32 | 32 | | or obligations, that district and the district to which the |
|---|
| 33 | 33 | | territory is to be added shall enter into an agreement that ensures |
|---|
| 34 | 34 | | that the debts of the originating district are not impaired by the |
|---|
| 35 | 35 | | transfer of the territory. |
|---|
| 36 | 36 | | (b) On entering the agreement, the districts shall adopt a |
|---|
| 37 | 37 | | joint resolution approving the petition. The resolution must |
|---|
| 38 | 38 | | provide the date on which the transfer is to be effective. On that |
|---|
| 39 | 39 | | date, the requested land is annexed to the territory of the district |
|---|
| 40 | 40 | | that is proposed to receive the land. |
|---|
| 41 | 41 | | Sec. 36.344. NOTIFICATION OF COMMISSION. Each district |
|---|
| 42 | 42 | | that adds or removes territory under this subchapter shall notify |
|---|
| 43 | 43 | | the commission of the change in territory. |
|---|
| 44 | 44 | | SECTION 2. This Act takes effect September 1, 2017. |
