| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 2054.376(a), Government Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (a) This subchapter applies to all information resources | |
| 13 | 13 | technologies, including [other than] telecommunications service | |
| 14 | 14 | provided under Chapter 2170, advanced communications services, and | |
| 15 | 15 | [or] information service, as those terms are defined by 47 U.S.C. | |
| 16 | 16 | Section 153, that are: | |
| 17 | 17 | (1) obtained by a state agency using state money; | |
| 18 | 18 | (2) used by a state agency; or | |
| 19 | 19 | (3) used by a participating local government. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2017. |
