7 | 7 | | relating to the authority of municipalities to replat a subdivision |
---|
8 | 8 | | without vacating the preceding plat. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 212.0146, Local Government Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | Sec. 212.0146. REPLATTING WITHOUT VACATING PRECEDING |
---|
13 | 13 | | PLAT[: CERTAIN MUNICIPALITIES]. (a) [This section applies only to |
---|
14 | 14 | | a replat of a subdivision or a part of a subdivision located in a |
---|
15 | 15 | | municipality or the extraterritorial jurisdiction of a |
---|
16 | 16 | | municipality with a population of 1.3 million or more. |
---|
17 | 17 | | [(b)] A replat of a subdivision or part of a subdivision may |
---|
18 | 18 | | be recorded and is controlling over the preceding plat without |
---|
19 | 19 | | vacation of that plat if: |
---|
20 | 20 | | (1) the replat is signed and acknowledged by each |
---|
21 | 21 | | owner and only the owners of the property being replatted; |
---|
22 | 22 | | (2) the municipal authority responsible for approving |
---|
23 | 23 | | plats holds a public hearing on the matter at which parties in |
---|
24 | 24 | | interest and citizens have an opportunity to be heard; |
---|
25 | 25 | | (3) the replat does not amend, remove, or violate, or |
---|
26 | 26 | | have the effect of amending, removing, or violating, any covenants |
---|
27 | 27 | | or restrictions that are contained or referenced in a dedicatory |
---|
28 | 28 | | instrument recorded in the real property records separately from |
---|
29 | 29 | | the preceding plat or replat; |
---|
30 | 30 | | (4) the replat does not attempt to amend, remove, or |
---|
31 | 31 | | violate, or have the effect of amending, removing, or violating, |
---|
32 | 32 | | any existing public utility easements without the consent of the |
---|
33 | 33 | | affected utility companies; and |
---|
34 | 34 | | (5) the municipal authority responsible for approving |
---|
35 | 35 | | plats approves the replat after determining that the replat |
---|
36 | 36 | | complies with this subchapter and rules adopted under Section |
---|
37 | 37 | | 212.002 and this section in effect at the time the application for |
---|
38 | 38 | | the replat is filed. |
---|
39 | 39 | | (b) [(c)] The governing body of a municipality may adopt |
---|
40 | 40 | | rules governing replats, including rules that establish criteria |
---|
41 | 41 | | under which covenants, restrictions, or plat notations that are |
---|
42 | 42 | | contained only in the preceding plat or replat without reference in |
---|
43 | 43 | | any dedicatory instrument recorded in the real property records |
---|
44 | 44 | | separately from the preceding plat or replat may be amended or |
---|
45 | 45 | | removed. |
---|
46 | 46 | | SECTION 2. This Act takes effect September 1, 2017. |
