| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter E, Chapter 508, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 508.158 to read as follows: |
|---|
| 12 | 12 | | Sec. 508.158. ALTERNATIVE HOUSING PROGRAM. The department |
|---|
| 13 | 13 | | shall require that an applicant to participate as a provider in a |
|---|
| 14 | 14 | | program designed to provide alternative housing for two or more |
|---|
| 15 | 15 | | unrelated releasees must provide notice by mail of the applicant's |
|---|
| 16 | 16 | | request to participate in the program to each public school, |
|---|
| 17 | 17 | | including an open-enrollment charter school, private school, or |
|---|
| 18 | 18 | | day-care facility located within 1,000 feet of the proposed |
|---|
| 19 | 19 | | alternative housing location. The department shall require the |
|---|
| 20 | 20 | | applicant to submit with the application, in the manner specified |
|---|
| 21 | 21 | | by the department, a list of each school or facility provided notice |
|---|
| 22 | 22 | | under this section and an affidavit of the applicant stating that |
|---|
| 23 | 23 | | the applicant has complied with this section. |
|---|
| 24 | 24 | | SECTION 2. (a) Not later than December 1, 2017, the Texas |
|---|
| 25 | 25 | | Department of Criminal Justice shall update application forms as |
|---|
| 26 | 26 | | necessary to implement Section 508.158, Government Code, as added |
|---|
| 27 | 27 | | by this Act. |
|---|
| 28 | 28 | | (b) Section 508.158, Government Code, as added by this Act, |
|---|
| 29 | 29 | | applies only to an application to participate in a program |
|---|
| 30 | 30 | | described by that section that is submitted on or after January 1, |
|---|
| 31 | 31 | | 2018. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2017. |
