49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the authority of a defense base development authority
712 to participate in a company or partnership organized to finance
813 redevelopment projects.
914 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1015 SECTION 1. Section 379B.004(a), Local Government Code, is
1116 amended to read as follows:
1217 (a) An authority may exercise power necessary or convenient
1318 to carry out a purpose of this chapter, including the power to:
1419 (1) adopt an official seal, or alter it;
1520 (2) adopt rules;
1621 (3) enter into a contract or incur a liability;
1722 (4) acquire and dispose of money;
1823 (5) select a depository;
1924 (6) establish a system of accounts for the authority;
2025 (7) invest funds in accordance with Chapter 2256,
2126 Government Code;
2227 (8) set the fiscal year for the authority;
2328 (9) adopt an annual operating budget for major
2429 expenditures before the beginning of the fiscal year;
2530 (10) borrow money or issue a bond in an amount that
2631 does not exceed the maximum amount set by the board;
2732 (11) loan money;
2833 (12) acquire, lease, lease-purchase, convey, grant a
2934 mortgage on, or otherwise dispose of a property right, including a
3035 right regarding base property;
3136 (13) lease property located on the base property to a
3237 person to effect the purposes of this chapter;
3338 (14) request and accept a donation, grant, guaranty,
3439 or loan from any source permitted by law;
3540 (15) operate and maintain an office;
3641 (16) charge for the use, lease, or sale of an open
3742 space or a facility;
3843 (17) exercise a power granted to a municipality by
3944 Chapter 380;
4045 (18) authorize by resolution the incorporation of a
4146 nonprofit airport facility financing corporation as provided and
4247 authorized by Subchapter E, Chapter 22, Transportation Code, to
4348 provide financing to pay the costs, including interest, and
4449 reserves for the costs of an airport facility authorized by that
4550 chapter and for other purposes set forth in the articles of
4651 incorporation;
4752 (19) exercise the powers granted to a local government
4853 for the financing of facilities to be located on airport property,
4954 including those set out in Chapter 22, Transportation Code,
5055 consistent with the requirements and the purposes of Section 52-a,
5156 Article III, Texas Constitution;
5257 (20) lease, own, and operate an airport and exercise
5358 the powers granted to municipalities and counties by Chapter 22,
5459 Transportation Code;
5560 (21) lease, own, and operate port facilities for air,
5661 trucking, and rail transportation;
5762 (22) provide security for port functions, facilities,
5863 and operations; [and]
5964 (23) cooperate with and participate in programs and
6065 security efforts of this state and the federal Department of
6166 Homeland Security; and
6267 (24) participate as a member or partner of a limited
6368 liability company, a limited liability partnership, or other entity
6469 organized to finance a project designated as a redevelopment
6570 project under Section 379B.009.
6671 SECTION 2. This Act takes effect immediately if it receives
6772 a vote of two-thirds of all the members elected to each house, as
6873 provided by Section 39, Article III, Texas Constitution. If this
6974 Act does not receive the vote necessary for immediate effect, this
7075 Act takes effect September 1, 2017.
