55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the implementation of county solid waste management
88 programs in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 364.011, Health and Safety Code, is
1111 amended by amending Subsection (a) and adding Subsection (a-1) to
1212 read as follows:
1313 (a) Subject to the limitation provided by Sections 361.151
1414 and 361.152 (Solid Waste Disposal Act), and subject to Subsection
1515 (a-1), a commissioners court by rule may regulate solid waste
1616 collection, handling, storage, and disposal in areas of the county
1717 not in a municipality or the extraterritorial jurisdiction of a
1818 municipality.
1919 (a-1) A commissioners court by rule may regulate solid waste
2020 collection, handling, storage, and disposal by establishing a
2121 mandatory program under Section 364.034 in an area of the county
2222 located within the extraterritorial jurisdiction of a municipality
2323 if:
2424 (1) the municipality does not provide solid waste
2525 disposal services in that area; and
2626 (2) the county:
2727 (A) is adjacent to the United Mexican States;
2828 (B) has a population of less than 300,000; and
2929 (C) contains a municipality with a population of
3030 200,000 or more.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2017.
