| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 364.011, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by amending Subsection (a) and adding Subsection (a-1) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) Subject to the limitation provided by Sections 361.151 |
|---|
| 14 | 14 | | and 361.152 (Solid Waste Disposal Act), and subject to Subsection |
|---|
| 15 | 15 | | (a-1), a commissioners court by rule may regulate solid waste |
|---|
| 16 | 16 | | collection, handling, storage, and disposal in areas of the county |
|---|
| 17 | 17 | | not in a municipality or the extraterritorial jurisdiction of a |
|---|
| 18 | 18 | | municipality. |
|---|
| 19 | 19 | | (a-1) A commissioners court by rule may regulate solid waste |
|---|
| 20 | 20 | | collection, handling, storage, and disposal by establishing a |
|---|
| 21 | 21 | | mandatory program under Section 364.034 in an area of the county |
|---|
| 22 | 22 | | located within the extraterritorial jurisdiction of a municipality |
|---|
| 23 | 23 | | if: |
|---|
| 24 | 24 | | (1) the municipality does not provide solid waste |
|---|
| 25 | 25 | | disposal services in that area; and |
|---|
| 26 | 26 | | (2) the county: |
|---|
| 27 | 27 | | (A) is adjacent to the United Mexican States; |
|---|
| 28 | 28 | | (B) has a population of less than 300,000; and |
|---|
| 29 | 29 | | (C) contains a municipality with a population of |
|---|
| 30 | 30 | | 200,000 or more. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2017. |
