| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Chapter 31, Penal Code, is amended by adding |
|---|
| 9 | 11 | | Section 31.19 to read as follows: |
|---|
| 10 | 12 | | Sec. 31.19. THEFT OF PETROLEUM PRODUCT. (a) In this |
|---|
| 11 | 13 | | section, "petroleum product" means crude oil, natural gas, or |
|---|
| 12 | 14 | | condensate. |
|---|
| 13 | 15 | | (b) A person commits an offense if the person unlawfully |
|---|
| 14 | 16 | | appropriates a petroleum product with intent to deprive the owner |
|---|
| 15 | 17 | | of the petroleum product by: |
|---|
| 16 | 18 | | (1) possessing, removing, delivering, receiving, |
|---|
| 17 | 19 | | purchasing, selling, moving, concealing, or transporting the |
|---|
| 18 | 20 | | petroleum product; or |
|---|
| 19 | 21 | | (2) making or causing a connection to be made with, or |
|---|
| 20 | 22 | | drilling or tapping or causing a hole to be drilled or tapped in, a |
|---|
| 21 | 23 | | pipe, pipeline, or tank used to store or transport a petroleum |
|---|
| 22 | 24 | | product. |
|---|
| 23 | 25 | | (c) Appropriation of a petroleum product is unlawful if it |
|---|
| 24 | 26 | | is without the owner's effective consent. |
|---|
| 25 | 27 | | (d) An offense under this section is: |
|---|
| 26 | 28 | | (1) a state jail felony if the total value of the |
|---|
| 27 | 29 | | petroleum product appropriated is less than $10,000; |
|---|
| 28 | 30 | | (2) a felony of the third degree if the total value of |
|---|
| 29 | 31 | | the petroleum product appropriated is $10,000 or more but less than |
|---|
| 30 | 32 | | $100,000; |
|---|
| 31 | 33 | | (3) a felony of the second degree if the total value of |
|---|
| 32 | 34 | | the petroleum product appropriated is $100,000 or more but less |
|---|
| 33 | 35 | | than $300,000; or |
|---|
| 34 | 36 | | (4) a felony of the first degree if the total value of |
|---|
| 35 | 37 | | the petroleum product appropriated is $300,000 or more. |

| 36 | 38 | | SECTION 2. This Act takes effect September 1, 2017. |
