57 relating to the creation of the offense of theft of petroleum
68 products.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Chapter 31, Penal Code, is amended by adding
911 Section 31.19 to read as follows:
1012 Sec. 31.19. THEFT OF PETROLEUM PRODUCT. (a) In this
1113 section, "petroleum product" means crude oil, natural gas, or
1214 condensate.
1315 (b) A person commits an offense if the person unlawfully
1416 appropriates a petroleum product with intent to deprive the owner
1517 of the petroleum product by:
1618 (1) possessing, removing, delivering, receiving,
1719 purchasing, selling, moving, concealing, or transporting the
1820 petroleum product; or
1921 (2) making or causing a connection to be made with, or
2022 drilling or tapping or causing a hole to be drilled or tapped in, a
2123 pipe, pipeline, or tank used to store or transport a petroleum
2224 product.
2325 (c) Appropriation of a petroleum product is unlawful if it
2426 is without the owner's effective consent.
2527 (d) An offense under this section is:
2628 (1) a state jail felony if the total value of the
2729 petroleum product appropriated is less than $10,000;
2830 (2) a felony of the third degree if the total value of
2931 the petroleum product appropriated is $10,000 or more but less than
3032 $100,000;
3133 (3) a felony of the second degree if the total value of
3234 the petroleum product appropriated is $100,000 or more but less
3335 than $300,000; or
3436 (4) a felony of the first degree if the total value of
3537 the petroleum product appropriated is $300,000 or more.
3638 SECTION 2. This Act takes effect September 1, 2017.
