7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Section 38.0141, Education Code, is amended to |
---|
9 | 11 | | read as follows: |
---|
10 | 12 | | Sec. 38.0141. REPORTING OF CERTAIN HEALTH AND SAFETY |
---|
11 | 13 | | INFORMATION REQUIRED. (a) Each school district shall provide to |
---|
12 | 14 | | the agency information as required by the commissioner, including |
---|
13 | 15 | | statistics and data, relating to student health and physical |
---|
14 | 16 | | activity and information described by Section 28.004(k), presented |
---|
15 | 17 | | in a form determined by the commissioner. The district shall |
---|
16 | 18 | | provide the information required by this subsection [section] for |
---|
17 | 19 | | the district and for each campus in the district. |
---|
18 | 20 | | (b) Not later than one year after the agency receives the |
---|
19 | 21 | | information required by Subsection (a), the commissioner shall |
---|
20 | 22 | | complete a report on physical education provided by each school |
---|
21 | 23 | | district and publish the report on the agency's Internet website. |
---|
22 | 24 | | (c) The report must include: |
---|
23 | 25 | | (1) the number of physical education classes offered |
---|
24 | 26 | | at each campus in the district and detail the number of days, |
---|
25 | 27 | | classes, and minutes offered each week by each campus; |
---|
26 | 28 | | (2) the ratio of students enrolled in physical |
---|
27 | 29 | | education classes in the district compared to the overall |
---|
28 | 30 | | enrollment; |
---|
29 | 31 | | (3) the average physical education class size at each |
---|
30 | 32 | | campus in the district; |
---|
31 | 33 | | (4) the number of physical education teachers in the |
---|
32 | 34 | | district who are licensed, certified, or endorsed by an accredited |
---|
33 | 35 | | teacher preparation program to teach physical education; |
---|
34 | 36 | | (5) whether each campus in the district has the |
---|
35 | 37 | | appropriate equipment and adequate facilities for students to |
---|
36 | 38 | | engage in the amount and intensity of physical activity required |
---|
37 | 39 | | under Section 28.002; |
---|
38 | 40 | | (6) whether the district allows modifications or |
---|
39 | 41 | | accommodations that allow physical education courses to meet the |
---|
40 | 42 | | needs of students with disabilities; and |
---|
41 | 43 | | (7) whether the district has a policy that allows |
---|
42 | 44 | | teachers or administrators in the district to withhold physical |
---|
43 | 45 | | activity from a student as punishment. |
---|
44 | 46 | | SECTION 2. This Act takes effect immediately if it receives |
---|
45 | 47 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
47 | 49 | | Act does not receive the vote necessary for immediate effect, this |
---|
48 | 50 | | Act takes effect September 1, 2017. |
