| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. The heading to Section 223.003, Transportation |

| 9 | 11 | | Code, is amended to read as follows: |
|---|
| 10 | 12 | | Sec. 223.003. NOTICE OF PROPOSED CONTRACTS [BY MAIL]. |

| 11 | 13 | | SECTION 2. Sections 223.003(a), (b), and (c), |
|---|
| 12 | 14 | | Transportation Code, are amended to read as follows: |

| 13 | 15 | | (a) A person may apply to have the name of the person placed |
|---|
| 14 | 16 | | on a [mailing] list to receive notice of any proposed contracts. |
|---|
| 15 | 17 | | (b) The department shall send [mail] the notice to each |
|---|
| 16 | 18 | | person on that [mailing] list. The department may send the notice |
|---|
| 17 | 19 | | by mail or electronically to an e-mail address designated by the |
|---|
| 18 | 20 | | person. |
|---|
| 19 | 21 | | (c) The department may require each applicant to pay an |
|---|
| 20 | 22 | | annual subscription fee set by the department in an amount not to |
|---|
| 21 | 23 | | exceed the average annual costs of sending [mailing] notices to the |
|---|
| 22 | 24 | | applicant. |

| 23 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 29 | | Act takes effect September 1, 2017. |
