57 relating to sending notice of proposed contracts for highway

79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. The heading to Section 223.003, Transportation
911 Code, is amended to read as follows:
1012 Sec. 223.003. NOTICE OF PROPOSED CONTRACTS [BY MAIL].
1113 SECTION 2. Sections 223.003(a), (b), and (c),
1214 Transportation Code, are amended to read as follows:
1315 (a) A person may apply to have the name of the person placed
1416 on a [mailing] list to receive notice of any proposed contracts.
1517 (b) The department shall send [mail] the notice to each
1618 person on that [mailing] list. The department may send the notice
1719 by mail or electronically to an e-mail address designated by the
1820 person.
1921 (c) The department may require each applicant to pay an
2022 annual subscription fee set by the department in an amount not to
2123 exceed the average annual costs of sending [mailing] notices to the
2224 applicant.
2325 SECTION 3. This Act takes effect immediately if it receives
2426 a vote of two-thirds of all the members elected to each house, as
2527 provided by Section 39, Article III, Texas Constitution. If this
2628 Act does not receive the vote necessary for immediate effect, this
2729 Act takes effect September 1, 2017.
