46 AN ACT
57 relating to the service plan for the annexation by certain
68 municipalities of territory included in an emergency services
79 district.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 43.056(p), Local Government Code, is
1012 amended to read as follows:
1113 (p) This subsection applies only to a municipality in a
1214 county with a population of more than one million and less than 1.75
1315 [1.5] million. For a municipality that has adopted Chapter 143 and
1416 directly employs firefighters, a service plan that includes the
1517 provision of services to an area that, at the time the service plan
1618 is adopted, is located in the territory of an emergency services
1719 district:
1820 (1) must require the municipality's fire department to
1921 provide initial response to the annexed territory that is
2022 equivalent to that provided to other areas within the corporate
2123 boundaries of the municipality with similar topography, land use,
2224 and population density;
2325 (2) may not provide for municipal fire services to the
2426 annexed area solely or primarily by means of an automatic aid or
2527 mutual aid agreement with the affected emergency services district
2628 or other third-party provider of services; and
2729 (3) may authorize the emergency services district to
2830 provide supplemental fire and emergency medical services to the
2931 annexed area by means of an automatic aid or mutual aid agreement.
3032 SECTION 2. The change in law made by this Act to Section
3133 43.056(p), Local Government Code, applies only to the annexation of
3234 an area for which all parts of the statutory annexation process are
3335 begun on or after the effective date of this Act. The annexation of
3436 an area for which any part of the statutory annexation process was
3537 begun before the effective date of this Act is governed by the law
3638 in effect immediately before the effective date of this Act, and the
3739 former law is continued in effect for that purpose.
3840 SECTION 3. This Act takes effect September 1, 2017.
