76 relating to maternal mortality and morbidity and pregnancy-related
87 deaths, including postpartum depression.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 34.005, Health and Safety Code, is
1110 amended to read as follows:
1211 Sec. 34.005. DUTIES OF TASK FORCE. The task force shall:
1312 (1) study and review:
1413 (A) cases of pregnancy-related deaths; and
1514 (B) trends, rates, or disparities in
1615 pregnancy-related deaths and [in] severe maternal morbidity;
1716 (2) determine the feasibility of the task force
1817 studying cases of severe maternal morbidity; and
1918 (3) make recommendations to help reduce the incidence
2019 of pregnancy-related deaths and severe maternal morbidity in this
2120 state.
2221 SECTION 2. Sections 34.007(a) and (b), Health and Safety
2322 Code, are amended to read as follows:
2423 (a) The department shall determine a statistically
2524 significant number of cases of pregnancy-related deaths for review.
2625 The department shall either randomly select cases or select all
2726 cases for the task force to review under this subsection to reflect
2827 a cross-section of pregnancy-related deaths in this state.
2928 (b) The department shall statistically analyze aggregate
3029 data of pregnancy-related deaths and severe maternal morbidity in
3130 this state to identify any trends, rates, or disparities.
3231 SECTION 3. Chapter 34, Health and Safety Code, is amended by
3332 adding Section 34.0155 to read as follows:
3433 Sec. 34.0155. REPORT ON MATERNAL MORTALITY AND
3534 PREGNANCY-RELATED DEATHS. The commission shall:
3635 (1) evaluate options for reducing maternal mortality,
3736 focusing on the most prevalent causes of maternal mortality as
3837 identified in the task force's biennial report required under
3938 Section 34.015, and for treating postpartum depression in
4039 economically disadvantaged women;
4140 (2) submit a written report that summarizes the
4241 commission's efforts to accomplish the tasks described by
4342 Subdivision (1) to the governor, the lieutenant governor, the
4443 speaker of the house of representatives, the Legislative Budget
4544 Board, and the appropriate standing committees of the legislature
4645 not later than December 1 of each even-numbered year; and
4746 (3) to the extent authorized by state and federal law,
4847 apply for federal money to fund the screening and treatment of
4948 postpartum depression under Section 10005 of the 21st Century Cures
5049 Act (42 U.S.C. Section 201 et seq.) and consider the
5150 recommendations contained in the task force's biennial report in
5251 using any federal grant money received.
5352 SECTION 4. Section 34.018, Health and Safety Code, is
5453 amended to read as follows:
5554 Sec. 34.018. SUNSET PROVISION. The task force is subject to
5655 Chapter 325, Government Code (Texas Sunset Act). Unless continued
5756 in existence as provided by that chapter, the task force is
5857 abolished and this chapter expires December 31, 2023 [September 1,
5958 2019].
6059 SECTION 5. This Act takes effect September 1, 2017.
