46 AN ACT
57 relating to the issuance of specially marked driver's licenses and
68 personal identification certificates to disabled veterans.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 521.011, Transportation Code, is amended
911 to read as follows:
1012 Sec. 521.011. SERVICES INFORMATION FOR VETERANS. The
1113 department and the Texas Veterans Commission shall jointly develop
1214 a one-page informational paper about veterans services provided by
1315 this state for veterans who receive:
1416 (1) a driver's license with a designation under
1517 Section 521.1235; or
1618 (2) a personal identification certificate with a
1719 [veteran's] designation under Section 521.102 [a one-page
1820 informational paper about veterans services provided by this
1921 state].
2022 SECTION 2. Section 521.101(l), Transportation Code, is
2123 amended to read as follows:
2224 (l) The application for the personal identification
2325 certificate must provide space for the applicant:
2426 (1) to voluntarily list any information [military
2527 service] that may qualify the applicant to receive a personal
2628 identification certificate with a [veteran's] designation under
2729 Section 521.102; and
2830 (2) to include proof required by the department to
2931 determine the applicant's eligibility to receive that designation.
3032 SECTION 3. Section 521.102, Transportation Code, is amended
3133 by amending Subsections (a) and (c) and adding Subsections (b-1),
3234 (d), (e), and (f) to read as follows:
3335 (a) In this section:
3436 (1) "Disability rating" has the meaning assigned by
3537 Section 11.22, Tax Code.
3638 (2) "Disabled veteran" and[,] "veteran" have the
3739 meanings assigned by Section 521.1235 [means a person who:
3840 [(1) has served in:
3941 [(A) the army, navy, air force, coast guard, or
4042 marine corps of the United States; or
4143 [(B) the Texas National Guard as defined by
4244 Section 431.001, Government Code; and
4345 [(2) has been honorably discharged from the branch of
4446 the service in which the person served].
4547 (b-1) If a disabled veteran provides proof sufficient to the
4648 department, the department, on request of the disabled veteran,
4749 shall include on a personal identification certificate issued to
4850 the disabled veteran in any available space on the face of the
4951 personal identification certificate or on the reverse side of the
5052 personal identification certificate:
5153 (1) a disabled veteran designation; and
5254 (2) the branch of the service in which the disabled
5355 veteran served.
5456 (c) The department shall provide to the recipient of a
5557 personal identification certificate with a [veteran's] designation
5658 under this section the informational paper described by Section
5759 521.011 at the time the certificate is issued.
5860 (d) Notwithstanding any other law and except as provided by
5961 Subsection (e), for purposes of obtaining a service or benefit
6062 available for disabled veterans in this state, a disabled veteran
6163 may use a personal identification certificate described by
6264 Subsection (b-1) as satisfactory proof:
6365 (1) that the disabled veteran has a disability rating
6466 described by Section 521.1235(a)(2)(A) or (B), as applicable; and
6567 (2) of branch of service and honorable discharge.
6668 (e) A personal identification certificate described by
6769 Subsection (b-1) is not satisfactory proof of the disabled
6870 veteran's disability rating for purposes of obtaining a property
6971 tax exemption provided by Chapter 11, Tax Code.
7072 (f) A disabled veteran who renews a personal identification
7173 certificate described by Subsection (b-1) shall provide proof
7274 sufficient to the department of the disabled veteran's disability
7375 rating.
7476 SECTION 4. Section 521.1235, Transportation Code, is
7577 amended by amending Subsections (a) and (c) and adding Subsections
7678 (b-1), (d), (e), and (f) to read as follows:
7779 (a) In this section:
7880 (1) "Disability rating" has the meaning assigned by
7981 Section 11.22, Tax Code.
8082 (2) "Disabled veteran" means a veteran who has
8183 suffered a service-connected disability with a disability rating
8284 of:
8385 (A) at least 50 percent; or
8486 (B) 40 percent if the rating is due to the
8587 amputation of a lower extremity.
8688 (3) "Veteran"[, "veteran"] means a person who:
8789 (A) [(1)] has served in:
8890 (i) [(A)] the army, navy, air force, coast
8991 guard, or marine corps of the United States; or
9092 (ii) [(B)] the Texas National Guard as
9193 defined by Section 437.001, Government Code; and
9294 (B) [(2)] has been honorably discharged from the
9395 branch of the service in which the person served.
9496 (b-1) If a disabled veteran provides proof sufficient to the
9597 department, the department, on request of the disabled veteran,
9698 shall include on a driver's license issued to the disabled veteran
9799 in any available space on the face of the driver's license or on the
98100 reverse side of the driver's license:
99101 (1) a disabled veteran designation; and
100102 (2) the branch of the service in which the disabled
101103 veteran served.
102104 (c) The department shall provide to the recipient of a
103105 driver's license with a [veteran's] designation under this section
104106 the informational paper described by Section 521.011 at the time
105107 the license is issued.
106108 (d) Notwithstanding any other law and except as provided by
107109 Subsection (e), for purposes of obtaining a service or benefit
108110 available for disabled veterans in this state, a disabled veteran
109111 may use a driver's license described by Subsection (b-1) as
110112 satisfactory proof:
111113 (1) that the disabled veteran has a disability rating
112114 described by Subsection (a)(2)(A) or (B), as applicable; and
113115 (2) of branch of service and honorable discharge.
114116 (e) A driver's license described by Subsection (b-1) is not
115117 satisfactory proof of the disabled veteran's disability rating for
116118 purposes of obtaining a property tax exemption provided by Chapter
117119 11, Tax Code.
118120 (f) A disabled veteran who renews a driver's license
119121 described by Subsection (b-1) shall provide proof sufficient to the
120122 department of the disabled veteran's disability rating.
121123 SECTION 5. Section 521.142(i), Transportation Code, is
122124 amended to read as follows:
123125 (i) The application must provide space for the applicant:
124126 (1) to voluntarily list any information [military
125127 service] that may qualify the applicant to receive a license with a
126128 [veteran's] designation under Section 521.1235; and
127129 (2) to include proof required by the department to
128130 determine the applicant's eligibility to receive that designation.
129131 SECTION 6. This Act takes effect September 1, 2017.
