46 AN ACT
57 relating to off-site sales by a dealer for antique or special
68 interest vehicles that have been subject to a retail sale.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 503.024(c), Transportation Code, is
911 amended to read as follows:
1012 (c) For the purposes of Section 503.021, a domiciliary of
1113 another state who holds a dealer license and bond, if applicable,
1214 issued by the other state is not engaging in business as a dealer
1315 by:
1416 (1) buying a vehicle from, selling a vehicle to, or
1517 exchanging a vehicle with a person who:
1618 (A) [(1)] holds a general distinguishing number
1719 issued by the department, if the transaction is not intended to
1820 avoid a requirement of this chapter; or
1921 (B) [(2)] is a domiciliary of another state who
2022 holds a dealer license and bond, if applicable, issued by the other
2123 state and the transaction is not intended to avoid a requirement of
2224 this chapter; or
2325 (2) buying, selling, including by consignment, or
2426 exchanging at a public auction:
2527 (A) an antique vehicle that is at least 25 years
2628 of age; or
2729 (B) a special interest vehicle that:
2830 (i) is at least 12 years of age; or
2931 (ii) has been the subject of a retail sale.
3032 SECTION 2. This Act takes effect September 1, 2017.
