77 relating to the expiration date of hunting and fishing licenses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 42.0175(a), Parks and Wildlife Code, is
1010 amended to read as follows:
1111 (a) A license issued under this chapter, other than a
1212 lifetime resident hunting license or a nonresident five-day special
1313 hunting license, is valid for one year from the last day of the
1414 month in which the license is issued [only during the yearly period
1515 for which the license is issued without regard to the date on which
1616 a license is acquired. Each yearly period begins on September 1 or
1717 on another date set by the commission and extends through August 31
1818 of the next year or another date set by the commission. A license
1919 issued under this chapter other than a nonresident five-day special
2020 hunting license that is issued before September 1 or another date
2121 set by the commission and does not expire until August 31 of the
2222 next year or another date set by the commission is valid from the
2323 date of issuance through August 31 of the following year or another
2424 date set by the commission. The commission by rule may set the
2525 amount of a license fee for a license issued during a transition
2626 period at an amount lower than prescribed in this chapter and
2727 provide for a license term for a transition period that is shorter
2828 or longer than a year].
2929 SECTION 2. Sections 42.022(a) and (d), Parks and Wildlife
3030 Code, are amended to read as follows:
3131 (a) No person may acquire or possess more than one hunting
3232 license during a license period [year]. [For purposes of this
3333 section, a violation does not occur unless a person acquires or
3434 possesses more than one license having the same expiration date.]
3535 (d) For purposes of this section, a license period [year]
3636 begins on the date the license is issued [September 1 or another
3737 date set by the commission and extends through August 31 of the next
3838 year or another date set by the commission].
3939 SECTION 3. Sections 46.007(a) and (b), Parks and Wildlife
4040 Code, are amended to read as follows:
4141 (a) Except as provided by Subsections (b), (c), [(d),] (e),
4242 and (f) of this section, a license required or authorized by this
4343 subchapter is valid for one year from the last day of the month in
4444 which the license is issued [only during the yearly period for which
4545 it is issued without regard to the date on which the license is
4646 acquired. Each yearly period begins on September 1 or another date
4747 set by the commission and extends through August 31 of the next year
4848 or another date set by the commission. The commission by rule may
4949 set the amount of a license fee for a license issued during a
5050 transition period at an amount lower than prescribed in this
5151 section and provide for a license term for a transition period that
5252 is shorter or longer than a year].
5353 (b) A license issued under Section 46.005 or 46.0051 [of
5454 this code] is valid for the number of consecutive days authorized on
5555 the license [and does not necessarily expire on August 31 or another
5656 date set by the commission].
5757 SECTION 4. Section 50.0021(a), Parks and Wildlife Code, is
5858 amended to read as follows:
5959 (a) Except as provided by Subsection [Subsections (b) and]
6060 (c) of this section, a license required or authorized by this
6161 chapter is valid for one year from the last day of the month in which
6262 the license is issued [only during the yearly period for which the
6363 license is issued without regard to the date on which the license is
6464 acquired. Each yearly period begins on September 1 or another date
6565 set by the commission and extends through August 31 of the next year
6666 or another date set by the commission. The commission by rule may
6767 set the amount of a license fee for a license issued during a
6868 transition period at an amount lower than prescribed in this
6969 chapter and provide for a license term for a transition period that
7070 is shorter or longer than a year].
7171 SECTION 5. The following provisions of the Parks and
7272 Wildlife Code are repealed:
7373 (1) Section 46.007(d); and
7474 (2) Section 50.0021(b).
7575 SECTION 6. The changes in law made by this Act apply only to
7676 a license issued by the Parks and Wildlife Department on or after
7777 the effective date of this Act. A license issued by the Parks and
7878 Wildlife Department before the effective date of this Act is
7979 covered by the law in effect when the license was issued, and the
8080 former law is continued in effect for that purpose.
8181 SECTION 7. This Act takes effect September 1, 2017.
