| 7 | 7 | | relating to the expiration date of hunting and fishing licenses. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 42.0175(a), Parks and Wildlife Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (a) A license issued under this chapter, other than a |
|---|
| 12 | 12 | | lifetime resident hunting license or a nonresident five-day special |
|---|
| 13 | 13 | | hunting license, is valid for one year from the last day of the |
|---|
| 14 | 14 | | month in which the license is issued [only during the yearly period |
|---|
| 15 | 15 | | for which the license is issued without regard to the date on which |
|---|
| 16 | 16 | | a license is acquired. Each yearly period begins on September 1 or |
|---|
| 17 | 17 | | on another date set by the commission and extends through August 31 |
|---|
| 18 | 18 | | of the next year or another date set by the commission. A license |
|---|
| 19 | 19 | | issued under this chapter other than a nonresident five-day special |
|---|
| 20 | 20 | | hunting license that is issued before September 1 or another date |
|---|
| 21 | 21 | | set by the commission and does not expire until August 31 of the |
|---|
| 22 | 22 | | next year or another date set by the commission is valid from the |
|---|
| 23 | 23 | | date of issuance through August 31 of the following year or another |
|---|
| 24 | 24 | | date set by the commission. The commission by rule may set the |
|---|
| 25 | 25 | | amount of a license fee for a license issued during a transition |
|---|
| 26 | 26 | | period at an amount lower than prescribed in this chapter and |
|---|
| 27 | 27 | | provide for a license term for a transition period that is shorter |
|---|
| 28 | 28 | | or longer than a year]. |

| 29 | 29 | | SECTION 2. Sections 42.022(a) and (d), Parks and Wildlife |
|---|
| 30 | 30 | | Code, are amended to read as follows: |
|---|
| 31 | 31 | | (a) No person may acquire or possess more than one hunting |
|---|
| 32 | 32 | | license during a license period [year]. [For purposes of this |
|---|
| 33 | 33 | | section, a violation does not occur unless a person acquires or |
|---|
| 34 | 34 | | possesses more than one license having the same expiration date.] |
|---|
| 35 | 35 | | (d) For purposes of this section, a license period [year] |
|---|
| 36 | 36 | | begins on the date the license is issued [September 1 or another |
|---|
| 37 | 37 | | date set by the commission and extends through August 31 of the next |
|---|
| 38 | 38 | | year or another date set by the commission]. |

| 39 | 39 | | SECTION 3. Sections 46.007(a) and (b), Parks and Wildlife |
|---|
| 40 | 40 | | Code, are amended to read as follows: |
|---|
| 41 | 41 | | (a) Except as provided by Subsections (b), (c), [(d),] (e), |
|---|
| 42 | 42 | | and (f) of this section, a license required or authorized by this |
|---|
| 43 | 43 | | subchapter is valid for one year from the last day of the month in |
|---|
| 44 | 44 | | which the license is issued [only during the yearly period for which |
|---|
| 45 | 45 | | it is issued without regard to the date on which the license is |
|---|
| 46 | 46 | | acquired. Each yearly period begins on September 1 or another date |
|---|
| 47 | 47 | | set by the commission and extends through August 31 of the next year |
|---|
| 48 | 48 | | or another date set by the commission. The commission by rule may |
|---|
| 49 | 49 | | set the amount of a license fee for a license issued during a |
|---|
| 50 | 50 | | transition period at an amount lower than prescribed in this |
|---|
| 51 | 51 | | section and provide for a license term for a transition period that |
|---|
| 52 | 52 | | is shorter or longer than a year]. |

| 53 | 53 | | (b) A license issued under Section 46.005 or 46.0051 [of |
|---|
| 54 | 54 | | this code] is valid for the number of consecutive days authorized on |
|---|
| 55 | 55 | | the license [and does not necessarily expire on August 31 or another |
|---|
| 56 | 56 | | date set by the commission]. |

| 57 | 57 | | SECTION 4. Section 50.0021(a), Parks and Wildlife Code, is |
|---|
| 58 | 58 | | amended to read as follows: |
|---|
| 59 | 59 | | (a) Except as provided by Subsection [Subsections (b) and] |
|---|

| 71 | 71 | | SECTION 5. The following provisions of the Parks and |
|---|
| 72 | 72 | | Wildlife Code are repealed: |
|---|
| 73 | 73 | | (1) Section 46.007(d); and |
|---|
| 74 | 74 | | (2) Section 50.0021(b). |
|---|
| 75 | 75 | | SECTION 6. The changes in law made by this Act apply only to |
|---|
| 76 | 76 | | a license issued by the Parks and Wildlife Department on or after |
|---|
| 77 | 77 | | the effective date of this Act. A license issued by the Parks and |
|---|
| 78 | 78 | | Wildlife Department before the effective date of this Act is |
|---|
| 79 | 79 | | covered by the law in effect when the license was issued, and the |
|---|
| 80 | 80 | | former law is continued in effect for that purpose. |
|---|
| 81 | 81 | | SECTION 7. This Act takes effect September 1, 2017. |
