7	6		relating to the deposit and distribution by the Texas Racing
8	7		Commission of certain pari-mutuel wagering funds to benefit the
9	8		Texas-bred program.
10	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	10		SECTION 1. Section 3.09, Texas Racing Act (Article 179e,
12	11		Vernon's Texas Civil Statutes), is amended by adding Subsection (c)
13	12		to read as follows:
14	13		(c) This section does not apply to money deposited into the
15	14		Texas-bred incentive fund established under Section 6.095 of this
16	15		Act.
17	16		SECTION 2. Section 6.08, Texas Racing Act (Article 179e,
18	17		Vernon's Texas Civil Statutes), is amended by amending Subsections
19	18		(d), (g), and (j) and adding Subsections (d-1) and (j-1) to read as
20	19		follows:
21	20		(d) A horse racing association shall set aside for the
22	21		Texas-bred program as provided by Subsection (f) of this section an
23	22		amount equal to one percent of a live multiple two wagering pool and
24	23		a live multiple three wagering pool and pay that amount to the
25	24		commission.
26	25		(d-1) The commission shall deposit money paid to the
27	26		commission under Subsection (d) of this section into the Texas-bred
28	27		incentive fund established under Section 6.095 of this Act. The
29	28		commission shall distribute the money collected under this section
30	29		and deposited into the fund to the appropriate state horse breed
31	30		registries for the Texas-bred program in accordance with this
32	31		section and commission rules adopted under Subsection (g) of this
33	32		section.
34	33		(g) The commission shall adopt rules relating to the
35	34		deposit, accounting, audit, and distribution of all amounts set
36	35		aside for the Texas-bred program under this section and for the use
37	36		of those amounts by the state breed registries under that program.
38	37		(j) Ten percent of the total breakage from a live
39	38		pari-mutuel pool or a simulcast pari-mutuel pool is to be retained
40	39		by the association to be used in stakes races restricted to
41	40		accredited Texas-bred horses. The association shall pay to the
42	41		commission for deposit into the Texas-bred incentive fund
43	42		established under Section 6.095 of this Act and distribution to the
44	43		appropriate state horse breed registry [shall pay out] the
45	44		remaining 80 percent of the total breakage to be allocated as
46	45		follows:
47	46		(1) 40 percent [of the remaining breakage is
48	47		allocated] to the owners of the accredited Texas-bred horses that
49	48		finish first, second, or third;
50	49		(2) 40 percent [is allocated] to the breeders of the
51	50		accredited Texas-bred horses that finish first, second, or third;
52	51		and
53	52		(3) 20 percent [is allocated] to the owner of the
54	53		stallion standing in this state at the time of conception whose
55	54		Texas-bred get finish first, second, or third.
56	55		(j-1) The commission shall deposit the portions of total
57	56		breakage paid to the commission under Subsections (i) and (j) of
58	57		this section into the Texas-bred incentive fund established under
59	58		Section 6.095 of this Act. The commission shall distribute the
60	59		money collected under this section and deposited into the fund to
61	60		the appropriate state horse breed registries in accordance with
62	61		this section and commission rules adopted under Subsection (g) of
63	62		this section.
64	63		SECTION 3. Section 6.09(d), Texas Racing Act (Article 179e,
65	64		Vernon's Texas Civil Statutes), is amended to read as follows:
66	65		(d) Fifty percent of the breakage is to be paid to the
67	66		appropriate state greyhound breeding registry. Of that portion of
68	67		the breakage 25 percent of that breakage is to be used in stakes
69	68		races and 25 percent of that total breakage from a live pari-mutuel
70	69		pool or a simulcast pari-mutuel pool is to be paid to the commission
71	70		for deposit into the Texas-bred incentive fund established under
72	71		Section 6.095 of this Act. The commission shall distribute the
73	72		money collected under this section and deposited into the fund to
74	73		[for the use by] the state greyhound breed registry for use in
75	74		accordance with this section, subject to rules promulgated by the
76	75		commission.
77	76		SECTION 4. Section 6.091, Texas Racing Act (Article 179e,
78	77		Vernon's Texas Civil Statutes), is amended by adding Subsection
79	78		(a-1) to read as follows:
80	79		(a-1) An association shall pay to the commission for deposit
81	80		into the Texas-bred incentive fund established under Section 6.095
82	81		of this Act the shares to be distributed under Subsections (a)(3)
83	82		and (4) of this section for the Texas-bred program. The commission
84	83		shall distribute the money collected under this section and
85	84		deposited into the fund to the appropriate state breed registries
86	85		for use under the Texas-bred program.
87	86		SECTION 5. Article 6, Texas Racing Act (Article 179e,
88	87		Vernon's Texas Civil Statutes), is amended by adding Section 6.095
89	88		to read as follows:
90	89		Sec. 6.095. TEXAS-BRED INCENTIVE FUND. The commission
91	90		shall deposit money set aside for the Texas-bred program under
92	91		Sections 6.08, 6.09, and 6.091 of this Act and money set aside for
93	92		use by state breed registries under Sections 6.08 and 6.09 of this
94	93		Act into an escrow account in the state treasury in the registry of
95	94		the commission to be known as the Texas-bred incentive fund. The
96	95		commission shall distribute money from the fund in accordance with
97	96		this article and commission rules.
98	97		SECTION 6. (a) The changes in law made by this Act to the
99	98		Texas Racing Act (Article 179e, Vernon's Texas Civil Statutes),
100	99		apply to the deductions and breakage from a wagering pool for a
101	100		horse or greyhound race conducted by a racetrack association on or
102	101		after the effective date of this Act.
103	102		(b) As soon as practicable after the effective date of this
104	103		Act, the Texas Racing Commission shall revise existing rules or
105	104		adopt new rules as necessary to comply with the Texas Racing Act
106	105		(Article 179e, Vernon's Texas Civil Statutes), as amended by this
107	106		Act.
108	107		SECTION 7. This Act takes effect only if a specific
109	108		appropriation for the implementation of the Act is provided in a
110	109		general appropriations act of the 85th Legislature.
111	110		SECTION 8. This Act takes effect September 1, 2017.
