65 AN ACT
76 relating to the deposit and distribution by the Texas Racing
87 Commission of certain pari-mutuel wagering funds to benefit the
98 Texas-bred program.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 3.09, Texas Racing Act (Article 179e,
1211 Vernon's Texas Civil Statutes), is amended by adding Subsection (c)
1312 to read as follows:
1413 (c) This section does not apply to money deposited into the
1514 Texas-bred incentive fund established under Section 6.095 of this
1615 Act.
1716 SECTION 2. Section 6.08, Texas Racing Act (Article 179e,
1817 Vernon's Texas Civil Statutes), is amended by amending Subsections
1918 (d), (g), and (j) and adding Subsections (d-1) and (j-1) to read as
2019 follows:
2120 (d) A horse racing association shall set aside for the
2221 Texas-bred program as provided by Subsection (f) of this section an
2322 amount equal to one percent of a live multiple two wagering pool and
2423 a live multiple three wagering pool and pay that amount to the
2524 commission.
2625 (d-1) The commission shall deposit money paid to the
2726 commission under Subsection (d) of this section into the Texas-bred
2827 incentive fund established under Section 6.095 of this Act. The
2928 commission shall distribute the money collected under this section
3029 and deposited into the fund to the appropriate state horse breed
3130 registries for the Texas-bred program in accordance with this
3231 section and commission rules adopted under Subsection (g) of this
3332 section.
3433 (g) The commission shall adopt rules relating to the
3534 deposit, accounting, audit, and distribution of all amounts set
3635 aside for the Texas-bred program under this section and for the use
3736 of those amounts by the state breed registries under that program.
3837 (j) Ten percent of the total breakage from a live
3938 pari-mutuel pool or a simulcast pari-mutuel pool is to be retained
4039 by the association to be used in stakes races restricted to
4140 accredited Texas-bred horses. The association shall pay to the
4241 commission for deposit into the Texas-bred incentive fund
4342 established under Section 6.095 of this Act and distribution to the
4443 appropriate state horse breed registry [shall pay out] the
4544 remaining 80 percent of the total breakage to be allocated as
4645 follows:
4746 (1) 40 percent [of the remaining breakage is
4847 allocated] to the owners of the accredited Texas-bred horses that
4948 finish first, second, or third;
5049 (2) 40 percent [is allocated] to the breeders of the
5150 accredited Texas-bred horses that finish first, second, or third;
5251 and
5352 (3) 20 percent [is allocated] to the owner of the
5453 stallion standing in this state at the time of conception whose
5554 Texas-bred get finish first, second, or third.
5655 (j-1) The commission shall deposit the portions of total
5756 breakage paid to the commission under Subsections (i) and (j) of
5857 this section into the Texas-bred incentive fund established under
5958 Section 6.095 of this Act. The commission shall distribute the
6059 money collected under this section and deposited into the fund to
6160 the appropriate state horse breed registries in accordance with
6261 this section and commission rules adopted under Subsection (g) of
6362 this section.
6463 SECTION 3. Section 6.09(d), Texas Racing Act (Article 179e,
6564 Vernon's Texas Civil Statutes), is amended to read as follows:
6665 (d) Fifty percent of the breakage is to be paid to the
6766 appropriate state greyhound breeding registry. Of that portion of
6867 the breakage 25 percent of that breakage is to be used in stakes
6968 races and 25 percent of that total breakage from a live pari-mutuel
7069 pool or a simulcast pari-mutuel pool is to be paid to the commission
7170 for deposit into the Texas-bred incentive fund established under
7271 Section 6.095 of this Act. The commission shall distribute the
7372 money collected under this section and deposited into the fund to
7473 [for the use by] the state greyhound breed registry for use in
7574 accordance with this section, subject to rules promulgated by the
7675 commission.
7776 SECTION 4. Section 6.091, Texas Racing Act (Article 179e,
7877 Vernon's Texas Civil Statutes), is amended by adding Subsection
7978 (a-1) to read as follows:
8079 (a-1) An association shall pay to the commission for deposit
8180 into the Texas-bred incentive fund established under Section 6.095
8281 of this Act the shares to be distributed under Subsections (a)(3)
8382 and (4) of this section for the Texas-bred program. The commission
8483 shall distribute the money collected under this section and
8584 deposited into the fund to the appropriate state breed registries
8685 for use under the Texas-bred program.
8786 SECTION 5. Article 6, Texas Racing Act (Article 179e,
8887 Vernon's Texas Civil Statutes), is amended by adding Section 6.095
8988 to read as follows:
9089 Sec. 6.095. TEXAS-BRED INCENTIVE FUND. The commission
9190 shall deposit money set aside for the Texas-bred program under
9291 Sections 6.08, 6.09, and 6.091 of this Act and money set aside for
9392 use by state breed registries under Sections 6.08 and 6.09 of this
9493 Act into an escrow account in the state treasury in the registry of
9594 the commission to be known as the Texas-bred incentive fund. The
9695 commission shall distribute money from the fund in accordance with
9796 this article and commission rules.
9897 SECTION 6. (a) The changes in law made by this Act to the
9998 Texas Racing Act (Article 179e, Vernon's Texas Civil Statutes),
10099 apply to the deductions and breakage from a wagering pool for a
101100 horse or greyhound race conducted by a racetrack association on or
102101 after the effective date of this Act.
103102 (b) As soon as practicable after the effective date of this
104103 Act, the Texas Racing Commission shall revise existing rules or
105104 adopt new rules as necessary to comply with the Texas Racing Act
106105 (Article 179e, Vernon's Texas Civil Statutes), as amended by this
107106 Act.
108107 SECTION 7. This Act takes effect only if a specific
109108 appropriation for the implementation of the Act is provided in a
110109 general appropriations act of the 85th Legislature.
111110 SECTION 8. This Act takes effect September 1, 2017.
