| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 6.091(a), Texas Racing Act (Article |
|---|
| 10 | 10 | | 179e, Vernon's Texas Civil Statutes), is amended to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (a) An association shall distribute from the total amount |
|---|
| 13 | 13 | | deducted as provided by Section 6.08(a) and 6.09(a) of this Act from |
|---|
| 14 | 14 | | each simulcast pari-mutuel pool and each simulcast cross-species |
|---|
| 15 | 15 | | pool the following shares: |
|---|
| 16 | 16 | | (1) an amount equal to one percent of each simulcast |
|---|
| 17 | 17 | | pool to the commission to fund the agency's activities [as the |
|---|
| 18 | 18 | | amount set aside for the state]; |
|---|
| 19 | 19 | | (2) an amount equal to 1.25 percent of each simulcast |
|---|
| 20 | 20 | | cross-species pool to the commission to fund the agency's |
|---|
| 21 | 21 | | activities [as the amount set aside for the state]; |
|---|
| 22 | 22 | | (3) if the association is a horse racing association, |
|---|
| 23 | 23 | | an amount equal to one percent of a multiple two wagering pool or |
|---|
| 24 | 24 | | multiple three wagering pool as the amount set aside for the |
|---|
| 25 | 25 | | Texas-bred program to be used as provided by Section 6.08(f) of this |
|---|
| 26 | 26 | | Act; |
|---|
| 27 | 27 | | (4) if the association is a greyhound association, an |
|---|
| 28 | 28 | | amount equal to one percent of a multiple two wagering pool or a |
|---|
| 29 | 29 | | multiple three wagering pool as the amount set aside for the |
|---|
| 30 | 30 | | Texas-bred program for greyhound races, to be distributed and used |
|---|
| 31 | 31 | | in accordance with rules of the commission adopted to promote |
|---|
| 32 | 32 | | greyhound breeding in this state; and |
|---|
| 33 | 33 | | (5) the remainder as the amount set aside for purses, |
|---|
| 34 | 34 | | expenses, the sending association, and the receiving location |
|---|
| 35 | 35 | | pursuant to a contract approved by the commission between the |
|---|
| 36 | 36 | | sending association and the receiving location. |
|---|
| 37 | 37 | | SECTION 2. Section 6.091(b), Texas Racing Act (Article |
|---|
| 38 | 38 | | 179e, Vernon's Texas Civil Statutes), is repealed. |
|---|
| 39 | 39 | | SECTION 3. (a) The changes in law made by this Act to |
|---|
| 40 | 40 | | Section 6.091, Texas Racing Act (Article 179e, Vernon's Texas Civil |
|---|
| 41 | 41 | | Statutes), apply to the deduction from a pari-mutuel pool for a race |
|---|
| 42 | 42 | | conducted by a racetrack association on or after the effective date |
|---|
| 43 | 43 | | of this Act. |
|---|
| 44 | 44 | | (b) As soon as practicable after the effective date of this |
|---|
| 45 | 45 | | Act, the Texas Racing Commission shall revise existing rules or |
|---|
| 46 | 46 | | adopt new rules as necessary to comply with Section 6.091, Texas |
|---|
| 47 | 47 | | Racing Act (Article 179e), Vernon's Texas Civil Statutes), as |
|---|
| 48 | 48 | | amended by this Act. |
|---|
| 49 | 49 | | SECTION 4. This Act takes effect September 1, 2017. |
