54 A BILL TO BE ENTITLED
65 AN ACT
76 relating to establishing the Texas Peace Officers' Memorial
87 Ceremony Committee to recognize and honor peace officers who were
98 killed in the line of duty.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. The heading to Chapter 3105, Government Code, is
1211 amended to read as follows:
1312 CHAPTER 3105. TEXAS PEACE OFFICERS' MEMORIAL MONUMENT AND CEREMONY
1413 SECTION 2. Section 3105.002, Government Code, is amended by
1514 adding Subdivision (2-a) to read as follows:
1615 (2-a) "Committee" means the Texas Peace Officers'
1716 Memorial Ceremony Committee.
1817 SECTION 3. Section 3105.005(c), Government Code, is amended
1918 to read as follows:
2019 (c) Money in the account may be used only for the purposes
2120 prescribed by Section 3105.004 [this chapter].
2221 SECTION 4. Chapter 3105, Government Code, is amended by
2322 adding Sections 3105.006 and 3105.007 to read as follows:
2423 Sec. 3105.006. TEXAS PEACE OFFICERS' MEMORIAL CEREMONY
2524 COMMITTEE. (a) The committee is established to plan, oversee, and
2625 facilitate annual ceremonies recognizing and honoring peace
2726 officers of this state who were killed in the line of duty.
2827 (b) The committee consists of the following members:
2928 (1) a president, or the president's designee, of any
3029 law enforcement organization that:
3130 (A) provides full service legal and political
3231 representation to law enforcement officers of this state;
3332 (B) has at least 10,000 members paying dues, as
3433 provided by the organization's Internal Revenue Service Form 990
3534 for the previous reporting period;
3635 (C) has complied with all filing requirements of
3736 the Internal Revenue Service, the United States Department of
3837 Labor, and the secretary of state; and
3938 (D) has an elected board of directors;
4039 (2) a surviving spouse of a peace officer killed in the
4140 line of duty selected by the chapters of the Concerns of Police
4241 Survivors of this state; and
4342 (3) the following nonvoting members or designees of
4443 the members:
4544 (A) the governor;
4645 (B) the lieutenant governor;
4746 (C) the speaker of the house of representatives;
4847 (D) the attorney general;
4948 (E) the director of the Department of Public
5049 Safety;
5150 (F) the executive director of the board; and
5251 (G) the executive director of the commission.
5352 Sec. 3105.007. TEXAS PEACE OFFICERS' MEMORIAL CEREMONY.
5453 (a) The committee shall meet as necessary to plan and coordinate
5554 an annual memorial ceremony on the Capitol grounds to honor Texas
5655 peace officers who were killed in the line of duty.
5756 (b) The committee shall hold the ceremony on a date selected
5857 by the committee during the week in which May 8 occurs.
5958 (c) The ceremony may be funded by public or private money.
6059 (d) Each odd-numbered year, the ceremony must include:
6160 (1) a parade of law enforcement color guards and
6261 personnel ending at the Capitol; and
6362 (2) a ceremony held during a joint session of the
6463 legislature on the floor of the house of representatives, if
6564 possible.
6665 (e) During the ceremony under this section, the name of each
6766 peace officer who is being added to the monument that year must be
6867 read and the surviving family members of the peace officer must be
6968 recognized.
7069 SECTION 5. This Act takes effect September 1, 2017.
