| 7 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 12 | | SECTION 1. Section 2306.6711(f), Government Code, is |
|---|
| 9 | 13 | | amended to read as follows: |
|---|
| 10 | 14 | | (f) The board may allocate housing tax credits to more than |
|---|
| 11 | 15 | | one development in a single community, as defined by department |
|---|
| 12 | 16 | | rule, in the same calendar year only if the developments are or will |
|---|
| 13 | 17 | | be located more than two linear miles apart or will serve different |
|---|
| 14 | 18 | | types of households, as defined by department rule. This |
|---|
| 15 | 19 | | subsection applies only to communities contained within counties |
|---|
| 16 | 20 | | with populations exceeding 1.5 [one] million. This subsection does |
|---|
| 17 | 21 | | not prohibit the department from adopting rules under this chapter |
|---|
| 18 | 22 | | that are specific to other geographic areas of the state. |
|---|
| 19 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 20 | 24 | | to an application for low income housing tax credits that is |
|---|
| 21 | 25 | | submitted to the Texas Department of Housing and Community Affairs |
|---|
| 22 | 26 | | during an application cycle that is based on the 2018 qualified |
|---|
| 23 | 27 | | allocation plan or a subsequent plan adopted by the governing board |
|---|
| 24 | 28 | | of the department. An application that is submitted during an |
|---|
| 25 | 29 | | application cycle that is based on an earlier qualified allocation |
|---|
| 26 | 30 | | plan is governed by the law in effect on the date the application |
|---|
| 27 | 31 | | cycle began, and the former law is continued in effect for that |
|---|
| 28 | 32 | | purpose. |

| 29 | 33 | | SECTION 3. This Act takes effect September 1, 2017. |
