9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 545.058(c), Transportation Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (c) A limitation in this section on driving on an improved | |
13 | 13 | shoulder does not apply to: | |
14 | 14 | (1) an authorized emergency vehicle responding to a | |
15 | 15 | call; | |
16 | 16 | (2) a police patrol; [or] | |
17 | 17 | (3) a bicycle; or | |
18 | 18 | (4) a public transit motor bus of a mass transit entity | |
19 | 19 | operating under Subtitle K, Title 6, if the motor bus is operating: | |
20 | 20 | (A) within the boundaries of a metropolitan | |
21 | 21 | planning organization in which: | |
22 | 22 | (i) at least five counties are located; and | |
23 | 23 | (ii) the two counties with the largest | |
24 | 24 | populations are part of a regional mobility authority governed by | |
25 | 25 | Chapter 370; and | |
26 | 26 | (B) on the shoulder of a highway designated by | |
27 | 27 | the Texas Department of Transportation. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2017. |
