77 relating to procedures for the determination of the validity of
88 certain petitions filed in connection with an election.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 277, Election Code, is amended by adding
1111 Sections 277.005 and 277.006 to read as follows:
1212 Sec. 277.005. PETITION FORM. (a) The secretary of state
1313 may adopt a petition form that may be used for a petition authorized
1414 or required to be filed by a law outside this code.
1515 (b) The authority to which a petition using the form adopted
1616 under Subsection (a) is submitted may not invalidate a petition
1717 because the petition did not contain information required by
1818 Section 277.002(a)(1) that the petition form failed to provide or
1919 to require to be provided.
2020 Sec. 277.006. CERTIFICATION OF VOTERS BY SECRETARY OF
2121 STATE. (a) The authority to which a petition is submitted shall
2222 provide the petition to the secretary of state for certification
2323 under Subsection (b).
2424 (b) The secretary of state shall certify whether the signers
2525 of a petition provided to the secretary under Subsection (a) are
2626 registered voters of the applicable territory and shall deliver the
2727 results of the certification to the authority.
2828 (c) An authority may not invalidate a petition signature
2929 based on the signer's ineligibility to sign the petition if the
3030 secretary of state certified the signer under this section.
3131 SECTION 2. Section 277.006, Election Code, as added by this
3232 Act, applies only to a petition submitted on or after the effective
3333 date of this Act.
3434 SECTION 3. This Act takes effect September 1, 2017.
