66 AN ACT
77 relating to the location and hours for early voting by personal
88 appearance.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 85.010(b), Election Code, is amended to
1111 read as follows:
1212 (b) A political subdivision that holds an election
1313 described by Subsection (a) shall designate as an early voting
1414 polling place for the election any early voting polling place[,
1515 other than a polling place established under Section 85.062(e),]
1616 established by the county and located in the political subdivision.
1717 SECTION 2. Section 85.062, Election Code, is amended by
1818 amending Subsections (a) and (b) and adding Subsection (h) to read
1919 as follows:
2020 (a) Except as provided by Subsection (d) [or (e)], one or
2121 more early voting polling places other than the main early voting
2222 polling place may be established by:
2323 (1) the commissioners court, for an election in which
2424 the county clerk is the early voting clerk; or
2525 (2) the governing body of the political subdivision
2626 served by the authority ordering the election, for an election in
2727 which a person other than the county clerk is the early voting
2828 clerk.
2929 (b) A polling place established under this section may be
3030 located, subject to Subsection (d), at any place in the territory
3131 served by the early voting clerk and may be located in any
3232 stationary structure as directed by the authority establishing the
3333 branch office. The polling place may be located in a movable
3434 structure, but the structure may not change locations during the
3535 early voting period [in the general election for state and county
3636 officers, general primary election, or runoff primary election].
3737 Ropes or other suitable objects may be used at the polling place to
3838 ensure compliance with Section 62.004. Persons who are not
3939 expressly permitted by law to be in a polling place shall be
4040 excluded from the polling place to the extent practicable.
4141 (h) In an election held by a political subdivision for which
4242 the ballot includes a proposition seeking voter approval of the
4343 issuance of bonds, a temporary branch polling place must:
4444 (1) remain at the same location for the entire period
4545 during which early voting by personal appearance is conducted in
4646 the district; and
4747 (2) allow for early voting by personal appearance to
4848 be conducted during the same days and hours as voting is conducted
4949 at the main early voting polling place under Section 85.005.
5050 SECTION 3. Section 85.063, Election Code, is amended to
5151 read as follows:
5252 Sec. 85.063. DAYS AND HOURS FOR VOTING: PERMANENT OR
5353 TEMPORARY BRANCH. Early voting by personal appearance at each
5454 permanent or temporary branch polling place shall be conducted on
5555 the same days and during the same hours as voting is conducted at
5656 the main early voting polling place.
5757 SECTION 4. Section 85.068(a), Election Code, is amended to
5858 read as follows:
5959 (a) The early voting clerk shall post notice for each
6060 election stating any dates and the hours that voting on Saturday or
6161 Sunday will be conducted at a temporary branch polling place [under
6262 Section 85.064(d) or 85.065(b)], if the early voting clerk is a
6363 county clerk or city secretary under Section 83.002 or 83.005.
6464 SECTION 5. The following provisions of the Election Code
6565 are repealed:
6666 (1) Section 42.002(c);
6767 (2) Section 85.062(e);
6868 (3) Section 85.064; and
6969 (4) Section 85.065.
7070 SECTION 6. This Act takes effect September 1, 2017.
