66 AN ACT
77 relating to the donation of sick leave by state employees.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 661.002(a), Government Code, is amended
1010 to read as follows:
1111 (a) The governing body of a state agency shall, through the
1212 establishment of a program, allow an agency employee to voluntarily
1313 transfer to a sick leave pool:
1414 (1) sick leave earned by the employee; and
1515 (2) sick leave donated to the employee under Section
1616 661.207.
1717 SECTION 2. Section 661.003(a), Government Code, is amended
1818 to read as follows:
1919 (a) An employee may contribute to the sick leave pool:
2020 (1) one or more days of the employee's accrued sick
2121 leave; and
2222 (2) sick leave donated to the employee under Section
2323 661.207.
2424 SECTION 3. Section 661.207, Government Code, is amended to
2525 read as follows:
2626 Sec. 661.207. DONATION OF SICK LEAVE. (a) An employee may
2727 donate any amount of the employee's accrued sick leave to another
2828 employee who is:
2929 (1) [is] employed in the same state agency as the donor
3030 employee; and
3131 (2) eligible to receive donated sick leave under
3232 Subsection (b) [has exhausted the employee's sick leave, including
3333 any time the individual may be eligible to withdraw from a sick
3434 leave pool].
3535 (b) An employee is eligible to receive donated sick leave
3636 under this section if:
3737 (1) the employee complies with Subsection (c); and
3838 (2) the administrative head of the employee's
3939 employing agency determines that:
4040 (A) the employee is experiencing a medical
4141 emergency or is caring for a member of the employee's immediate
4242 family who is experiencing a medical emergency; and
4343 (B) as a result of the medical emergency, the
4444 employee has exhausted all paid leave available to the employee,
4545 including any time the employee is eligible to withdraw from a sick
4646 leave pool.
4747 (c) An employee who requests donated sick leave under this
4848 section must provide the administrative head of the employing
4949 agency with a written statement from the licensed practitioner who
5050 is treating the employee or a member of the employee's immediate
5151 family. The statement must provide sufficient information
5252 regarding the condition of the employee or the employee's family
5353 member to enable the administrative head to determine whether the
5454 employee or the employee's family member is experiencing a medical
5555 emergency.
5656 (d) An employee may not provide or receive remuneration or a
5757 gift in exchange for a sick leave donation under this section.
5858 (e) Notwithstanding any other law, an [(c) An] employee
5959 who receives donated sick leave under this section may not[:
6060 [(1) use sick leave donated to the employee under this
6161 section except as provided by Sections 661.202(d) and (e); or
6262 [(2) notwithstanding any other law,] receive service
6363 credit in the Employees Retirement System of Texas for any sick
6464 leave donated to the employee under this section that is unused on
6565 the last day of that employee's employment.
6666 (f) For purposes of this section, a person is a member of an
6767 employee's immediate family if the person would be considered a
6868 member of the employee's immediate family under Section 661.202(d).
6969 (g) [(d)] In this section:
7070 (1) "Employee" [, "employee"] and "state agency" have
7171 the meanings assigned by Section 661.001.
7272 (2) "Medical emergency" means a severe medical
7373 condition that:
7474 (A) affects the mental or physical health of an
7575 employee or a member of the employee's immediate family;
7676 (B) requires treatment by a licensed
7777 practitioner; and
7878 (C) requires the employee's prolonged absence
7979 from work.
8080 SECTION 4. The change in law made by this Act applies only
8181 to a donation of sick leave that is made on or after the effective
8282 date of this Act. A donation of sick leave made before the
8383 effective date of this Act is governed by the law in effect when the
8484 sick leave was donated, and the former law is continued in effect
8585 for that purpose.
8686 SECTION 5. This Act takes effect September 1, 2017.
