55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the offense of tampering with a
88 governmental record; increasing a criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.10(c), Penal Code, is amended by
1111 amending Subdivision (1) and adding Subdivision (5) to read as
1212 follows:
1313 (1) Except as provided by Subdivisions (2), (3), [and]
1414 (4), and (5) and by Subsection (d), an offense under this section is
1515 a Class A misdemeanor unless the actor's intent is to defraud or
1616 harm another, in which event the offense is a state jail felony.
1717 (5) An offense under this section is a state jail
1818 felony if it is shown on the trial of the offense that the
1919 governmental record was a payroll document requesting payment of
2020 compensation to a state officer or employee.
2121 SECTION 2. The change in law made by this Act applies only
2222 to an offense committed on or after the effective date of this Act.
2323 An offense committed before the effective date of this Act is
2424 governed by the law in effect on the date the offense was committed,
2525 and the former law is continued in effect for that purpose. For
2626 purposes of this section, an offense was committed before the
2727 effective date of this Act if any element of the offense occurred
2828 before that date.
2929 SECTION 3. This Act takes effect September 1, 2017.
