55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to inclusion of instruction regarding interaction with
88 peace officers in the required curriculum for ninth grade public
99 school students and to civilian interaction training for peace
1010 officers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1313 amended by adding Section 28.012 to read as follows:
1414 Sec. 28.012. INSTRUCTION ON INTERACTION WITH LAW
1515 ENFORCEMENT. (a) In this section:
1616 (1) "Board" means the State Board of Education.
1717 (2) "Commission" means the Texas Commission on Law
1818 Enforcement.
1919 (b) The board and the commission shall enter into a
2020 memorandum of understanding that establishes each agency's
2121 respective responsibilities in developing instruction on proper
2222 interaction with peace officers during traffic stops and other
2323 in-person encounters.
2424 (c) The board and the commission may consult with any
2525 interested party in developing the instruction under this section.
2626 (d) Before finalizing any instruction under this section,
2727 the board and the commission shall provide a reasonable period for
2828 public comment.
2929 SECTION 2. Section 28.025, Education Code, is amended by
3030 adding Subsection (b-20) to read as follows:
3131 (b-20) The State Board of Education shall adopt rules to
3232 include the instruction developed under Section 28.012 in the
3333 required curriculum for students in ninth grade.
3434 SECTION 3. Section 1701.253, Occupations Code, is amended
3535 by adding Subsection (n) to read as follows:
3636 (n) As part of the minimum curriculum requirements, the
3737 commission shall require an officer to complete the civilian
3838 interaction training program developed under Section 1701.268. An
3939 officer shall complete the program not later than the second
4040 anniversary of the date the officer is licensed under this chapter
4141 unless the officer completes the program as part of the officer's
4242 basic training course.
4343 SECTION 4. Subchapter F, Chapter 1701, Occupations Code, is
4444 amended by adding Section 1701.268 to read as follows:
4545 Sec. 1701.268. CIVILIAN INTERACTION TRAINING PROGRAM. (a)
4646 In this section, "board" means the State Board of Education.
4747 (b) The commission and the board shall enter into a
4848 memorandum of understanding that establishes each agency's
4949 respective responsibilities in developing a training program on
5050 proper interaction with civilians during traffic stops and other
5151 in-person encounters.
5252 (c) The commission and the board may consult with any
5353 interested party in developing the training program under this
5454 section.
5555 (d) Before finalizing a training program under this
5656 section, the commission and the board shall provide a reasonable
5757 period for public comment.
5858 SECTION 5. (a) Not later than September 1, 2018, the State
5959 Board of Education and the Texas Commission on Law Enforcement
6060 shall develop:
6161 (1) the instruction required under Section 28.012,
6262 Education Code, as added by this Act; and
6363 (2) the training program required under Section
6464 1701.268, Occupations Code, as added by this Act.
6565 (b) Section 28.025(b-20), Education Code, as added by this
6666 Act, applies beginning with the 2018-2019 school year.
6767 (c) A peace officer or reserve law enforcement officer who
6868 holds a license under Chapter 1701, Occupations Code, issued on or
6969 before January 1, 2018, shall complete a training program
7070 established under Section 1701.268, Occupations Code, as added by
7171 this Act, not later than January 1, 2020.
7272 SECTION 6. This Act takes effect September 1, 2017.
