| 8 | 8 | | peace officers in the required curriculum for ninth grade public |
|---|
| 9 | 9 | | school students and to civilian interaction training for peace |
|---|
| 10 | 10 | | officers. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 28, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 28.012 to read as follows: |
|---|
| 14 | 14 | | Sec. 28.012. INSTRUCTION ON INTERACTION WITH LAW |
|---|
| 15 | 15 | | ENFORCEMENT. (a) In this section: |
|---|
| 16 | 16 | | (1) "Board" means the State Board of Education. |
|---|
| 17 | 17 | | (2) "Commission" means the Texas Commission on Law |
|---|
| 18 | 18 | | Enforcement. |
|---|
| 19 | 19 | | (b) The board and the commission shall enter into a |
|---|
| 20 | 20 | | memorandum of understanding that establishes each agency's |
|---|
| 21 | 21 | | respective responsibilities in developing instruction on proper |
|---|
| 22 | 22 | | interaction with peace officers during traffic stops and other |
|---|
| 23 | 23 | | in-person encounters. |
|---|
| 24 | 24 | | (c) The board and the commission may consult with any |
|---|
| 25 | 25 | | interested party in developing the instruction under this section. |
|---|
| 26 | 26 | | (d) Before finalizing any instruction under this section, |
|---|
| 27 | 27 | | the board and the commission shall provide a reasonable period for |
|---|
| 28 | 28 | | public comment. |
|---|
| 29 | 29 | | SECTION 2. Section 28.025, Education Code, is amended by |
|---|
| 30 | 30 | | adding Subsection (b-20) to read as follows: |
|---|
| 31 | 31 | | (b-20) The State Board of Education shall adopt rules to |
|---|
| 32 | 32 | | include the instruction developed under Section 28.012 in the |
|---|
| 33 | 33 | | required curriculum for students in ninth grade. |
|---|
| 34 | 34 | | SECTION 3. Section 1701.253, Occupations Code, is amended |
|---|
| 35 | 35 | | by adding Subsection (n) to read as follows: |
|---|
| 36 | 36 | | (n) As part of the minimum curriculum requirements, the |
|---|
| 37 | 37 | | commission shall require an officer to complete the civilian |
|---|
| 38 | 38 | | interaction training program developed under Section 1701.268. An |
|---|
| 39 | 39 | | officer shall complete the program not later than the second |
|---|
| 40 | 40 | | anniversary of the date the officer is licensed under this chapter |
|---|
| 41 | 41 | | unless the officer completes the program as part of the officer's |
|---|
| 42 | 42 | | basic training course. |
|---|
| 43 | 43 | | SECTION 4. Subchapter F, Chapter 1701, Occupations Code, is |
|---|
| 44 | 44 | | amended by adding Section 1701.268 to read as follows: |
|---|
| 45 | 45 | | Sec. 1701.268. CIVILIAN INTERACTION TRAINING PROGRAM. (a) |
|---|
| 46 | 46 | | In this section, "board" means the State Board of Education. |
|---|
| 47 | 47 | | (b) The commission and the board shall enter into a |
|---|
| 48 | 48 | | memorandum of understanding that establishes each agency's |
|---|
| 49 | 49 | | respective responsibilities in developing a training program on |
|---|

|---|

| 58 | 58 | | SECTION 5. (a) Not later than September 1, 2018, the State |
|---|
| 59 | 59 | | Board of Education and the Texas Commission on Law Enforcement |
|---|
| 60 | 60 | | shall develop: |
|---|
| 61 | 61 | | (1) the instruction required under Section 28.012, |
|---|
| 62 | 62 | | Education Code, as added by this Act; and |
|---|
| 63 | 63 | | (2) the training program required under Section |
|---|
| 64 | 64 | | 1701.268, Occupations Code, as added by this Act. |
|---|
| 65 | 65 | | (b) Section 28.025(b-20), Education Code, as added by this |
|---|
| 66 | 66 | | Act, applies beginning with the 2018-2019 school year. |
|---|
| 67 | 67 | | (c) A peace officer or reserve law enforcement officer who |
|---|
| 68 | 68 | | holds a license under Chapter 1701, Occupations Code, issued on or |
|---|
| 69 | 69 | | before January 1, 2018, shall complete a training program |
|---|
| 70 | 70 | | established under Section 1701.268, Occupations Code, as added by |
|---|
| 71 | 71 | | this Act, not later than January 1, 2020. |
|---|
| 72 | 72 | | SECTION 6. This Act takes effect September 1, 2017. |
