| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 1551.206(b), Insurance Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (b) The board of trustees may include in the cafeteria plan | |
| 13 | 13 | any benefit that may be included in a cafeteria plan under federal | |
| 14 | 14 | law. The cafeteria plan may include a student loan repayment | |
| 15 | 15 | benefit if authorized under federal law. | |
| 16 | 16 | SECTION 2. If before implementing Section 1551.206(b), | |
| 17 | 17 | Insurance Code, as amended by this Act, the board of trustees of the | |
| 18 | 18 | Employees Retirement System of Texas determines that federal | |
| 19 | 19 | authorization is necessary for implementation of that subsection, | |
| 20 | 20 | the board of trustees shall delay implementing that subsection | |
| 21 | 21 | until the authorization is granted. | |
| 22 | 22 | SECTION 3. (a) Except as provided by Subsection (b) of this | |
| 23 | 23 | section, this Act takes effect September 1, 2017. | |
| 24 | 24 | (b) Section 1 of this Act takes effect September 1, 2018. |
