| 7 | 7 | | relating to the authority of the Texas State Technical College |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 135.01, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (c) and adding Subsection (d) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (c) In developing and offering highly specialized technical |
|---|
| 14 | 14 | | programs with related supportive coursework, primary consideration |
|---|
| 15 | 15 | | shall be placed on industrial and technological manpower needs of |
|---|
| 16 | 16 | | the state. |
|---|
| 17 | 17 | | (d) The authority of the Texas State Technical College |
|---|
| 18 | 18 | | System to create a technical-vocational course of study or |
|---|
| 19 | 19 | | technical-vocational certificate or degree program under this |
|---|
| 20 | 20 | | section is not subject to Section 61.0512 [The emphasis of each |
|---|
| 21 | 21 | | Texas State Technical College System campus shall be on advanced or |
|---|
| 22 | 22 | | emerging technical programs not commonly offered by public junior |
|---|
| 23 | 23 | | colleges]. |

| 24 | 24 | | SECTION 2. Section 135.02(b), Education Code, is amended to |
|---|
| 25 | 25 | | read as follows: |
|---|
| 26 | 26 | | (b) The system may operate an extension center created after |
|---|
| 27 | 27 | | September 1, 1991, in a city or county if: |
|---|
| 28 | 28 | | (1) [the coordinating board has given prior approval |
|---|
| 29 | 29 | | to the extension center, after considering the role and mission of |
|---|
| 30 | 30 | | the system, the needs of this state and of the community involved, |
|---|
| 31 | 31 | | the actions of the legislature, if any, and the efficient and |
|---|
| 32 | 32 | | effective use of the state's educational resources for the economic |
|---|
| 33 | 33 | | development of this state; |
|---|
| 34 | 34 | | [(2)] a political subdivision of this state provides |
|---|
| 35 | 35 | | and maintains appropriate equipment and facilities for the delivery |
|---|
| 36 | 36 | | of technical-vocational education, including maintenance and |
|---|
| 37 | 37 | | utilities; and |
|---|
| 38 | 38 | | (2) [(3)] funding for the extension center is approved |
|---|
| 39 | 39 | | by specific legislative Act. |
|---|
| 40 | 40 | | SECTION 3. Section 135.04, Education Code, is repealed. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2017. |
