7 | 7 | | relating to the content of an application for Medicaid. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 32.025, Human Resources Code, is amended |
---|
10 | 10 | | by adding Subsection (g) to read as follows: |
---|
11 | 11 | | (g) The application form adopted under this section must |
---|
12 | 12 | | include: |
---|
13 | 13 | | (1) for an applicant who is pregnant, a question |
---|
14 | 14 | | regarding whether the pregnancy is the woman's first gestational |
---|
15 | 15 | | pregnancy; and |
---|
16 | 16 | | (2) a question regarding the applicant's preferences |
---|
17 | 17 | | for being contacted, as follows: |
---|
18 | 18 | | "If you are determined eligible for benefits, do |
---|
19 | 19 | | you want your managed care organization or health plan provider to |
---|
20 | 20 | | contact you by telephone, text message, or e-mail about health care |
---|
21 | 21 | | matters, including reminders for appointments and information |
---|
22 | 22 | | about immunizations or well check visits? Telephone calls and text |
---|
23 | 23 | | messages may be autodialed. Please indicate your preferences |
---|
24 | 24 | | below: |

32 | 32 | | SECTION 2. Not later than January 1, 2018, the executive |
---|
33 | 33 | | commissioner of the Health and Human Services Commission shall |
---|
34 | 34 | | adopt a revised application form for medical assistance benefits |
---|
35 | 35 | | that conforms to the requirements of Section 32.025(g), Human |
---|
36 | 36 | | Resources Code, as added by this Act. |
---|
37 | 37 | | SECTION 3. If before implementing any provision of this Act |
---|
38 | 38 | | a state agency determines that a waiver or authorization from a |
---|
39 | 39 | | federal agency is necessary for implementation of that provision, |
---|
40 | 40 | | the agency affected by the provision shall request the waiver or |
---|
41 | 41 | | authorization and may delay implementing that provision until the |
---|
42 | 42 | | waiver or authorization is granted. |
---|
43 | 43 | | SECTION 4. This Act takes effect immediately if it receives |
---|
44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
47 | 47 | | Act takes effect September 1, 2017. |
---|
