66 AN ACT
77 relating to the content of an application for Medicaid.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 32.025, Human Resources Code, is amended
1010 by adding Subsection (g) to read as follows:
1111 (g) The application form adopted under this section must
1212 include:
1313 (1) for an applicant who is pregnant, a question
1414 regarding whether the pregnancy is the woman's first gestational
1515 pregnancy; and
1616 (2) a question regarding the applicant's preferences
1717 for being contacted, as follows:
1818 "If you are determined eligible for benefits, do
1919 you want your managed care organization or health plan provider to
2020 contact you by telephone, text message, or e-mail about health care
2121 matters, including reminders for appointments and information
2222 about immunizations or well check visits? Telephone calls and text
2323 messages may be autodialed. Please indicate your preferences
2424 below:

3232 SECTION 2. Not later than January 1, 2018, the executive
3333 commissioner of the Health and Human Services Commission shall
3434 adopt a revised application form for medical assistance benefits
3535 that conforms to the requirements of Section 32.025(g), Human
3636 Resources Code, as added by this Act.
3737 SECTION 3. If before implementing any provision of this Act
3838 a state agency determines that a waiver or authorization from a
3939 federal agency is necessary for implementation of that provision,
4040 the agency affected by the provision shall request the waiver or
4141 authorization and may delay implementing that provision until the
4242 waiver or authorization is granted.
4343 SECTION 4. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2017.
